BACKGROUND INFORMATION: The contract was awarded to Boberg Hardwood Floors, of Sacramento, on October 4, 1995, in the amount of $21,950. The contract has been completed in substantial conformance with the plans and specifications approved by the City Council. There were minor problems with the finish coat but these were no fault of the contractor. These problems are being corrected. The contract completion date was December 1, 1995, and the actual completion date was November 15, 1995. The final contract price was $21,950. Dixon Flynn -- City Mb ager CACCPT.DOC 11/16/95 0 MEMORANDUM, City of Lodi, Public Works Department To: City Manager From: Public Works Director Date: December 13, 1995 Subject: Refinishing and Relining of Two Portable Basketball Floors In response to Council Member Davenport's December 6, 1995 memorandum (copy attached), it is true that the City experienced peeling of the final finish coat on the two portable basketball floors. However, the peeling was not the fault of the contractor and, therefore, it is appropriate to recommend the filing of a Notice of Completion with the County Recorder's office. Attached is a memorandum dated December 12, 1995 from Senior Civil Engineer Wes Fujitani explaining the problem we experienced with the finish coat. Under the specifications, the contractor was to disassemble the floor panels after the finish coat was cured. However, because of the Parks and Recreation Department's experience and knowledge of disassembly, they offered to dismantle the portable floor. As part of the disassembly, peeling of the final finish coat did take place. The contractor offered to make the required repairs at no cost to the City, but due to the scheduled use of the floors in the afternoons and evenings, the Parks and Recreation Department felt it would be in the City's best interest for them to do the work and coordinate it with their recreation schedule. The Notice of Completion only certifies that the contractor has completed his work and that the City accepts the work performed by the contractor. A sample Notice of Completion is attached. Mr. Ronsko suggests we accept the improvements and file a Notice of Completion with the County Recorder's office in regard to the aforementioned contract. I have been informed by extrinsic sources that in fact some areas of the floors finish is peeling. Upon inspection of the floors, the peeling may be related to the procedure and method of moving the portable panels. I do not support the filing of false statements by department heads. Additionally it is unacceptable for a department head to attempt to cover up the true condition of a project and fail to report conditions as they presently exist. I trust this problem will not occur in the future. cc: City Councilmembers City Attorney 0 MEMORANDUM, City of Lodi, Public Works Department To: Public Works Director From: Senior Civil Engineer Date: December 12, 1995 Subject: Resurfacing and Relining of Two Portable Basketball Floors I spoke to Tim McGeorge, Parks Supervisor, and Steve Virrey, Parks Project Coordinator, about the peeling of the finish coat on the basketball floors that were recently relined and refinished by Boberg Hardwood Floors. Both Tim and Steve felt that the peeling is a minor problem and that the repair work can be done by the Parks Department crew with minimal time and effort. The Parks Department had assembled both basketball floors and the City awarded Boberg Hardwood Floors a contract to sand the floors down to bare wood, seal and stripe the floors and apply a finish coat. After the finish coat was applied, the floors were to be disassembled so that the panels would not stick together. The peeling is occurring on the edges of the panels. Tim and Steve felt that the peeling is the result of the finish coat curing before the Parks crew disassembled the floor panels. The Parks crew did the disassembly of the floors because they were more familiar with the process and because they had more manpower so they could do the work quicker. During the application of the finish coat, Mike Boberg, the contractor, estimated that the coat would cure in about three hours. Tim and his crew checked the finish and began to break the panels as soon as the coat was not tacky (after approximately two hours). The finish coat just set up faster than anticipated. This same process was used on the second floor and there is some peeling but not as much as on the first floor. As soon as the peeling was discovered, Mike Boberg was called so that he_ could inspect the peeling. He offered to do all the repairs but the Parks Department felt it would be easier to have it done with the Parks crew. The repairs must be done in the morning because Tokay High is using the floors in the afternoon and the adult basketball program is using the floors in the evenings. Coordinating the repair work with Boberg Hardwood Floors would have been more difficult for the Parks crew than doing the work themselves. Mr. Boberg gave the City all the repair material and showed the Parks crew how to do the repair work. There is some bubbling in the first patch but the patch work has been blending with the finish coat much better as the crew has gained experience. According to Tim McGeorge, each patch is done in two to three minutes. The work of improvement consisted of reconstructing approximately 41,800 square feet of asphalt concrete pavement with 1,500 tons of asphalt concrete, installing 4,640 square yards of engineering fabric, installing 2 wheelchair ramps, and other incidental and related work as shown on the plans and specifications for this project.
