AGENDA TITLE: Improvement Deferral Agreement for 246 East Almond Drive, Lodi MEETING DATE: September 6, 1995 PREPARED BY: Public Works Director RECOMMENDED ACTION: That the City Council approve the Improvement Deferral Agreement for 246 East Almond Drive, and direct the City Manager and City Clerk to execute the agreement on behalf of the City. BACKGROUND INFORMATION: The City is currently in the process of widening the street paving and extending water and sanitary sewer laterals to several properties on Almond Drive immediately east of Stockton Street. Service laterals are being provided at this time to avoid cutting the new pavement should property owners not now receiving City services desire to connect. Property owners are not being required to connect to City services at this time. During the course of this project, it was discovered that the street paving operation would interfere with the existing septic system leach field at 246 East Almond Drive. Connection to the public sanitary sewer system seemed the most effective method of alleviating this problem. In order to accommodate the street paving project, staff decided to connect the discharge from the septic tank to the public sanitary sewer system and bypass the leach field. Since connection to the public sanitary sewer system at this time was necessitated by a City project, the property owners, James and Nancy Waitley, have requested that payment of the sewer capacity fees and abandonment of the existing septic system be deferred for eighteen (18) months. Staff feels this is a reasonable request and recommends that the deferral be granted. Owners have executed the necessary Improvement Deferral Agreement to allow deferral of the sewer capacity fee and septic system abandonment for eighteen (18 months. FUNDING: None required. /4 ack . PETER ON recycled paper City Manager C246EALM.DOC 061 a-, 0 MEMORANDUM, City of Lodi, Public Works Department To: City Council City Manager From: City Engineer Date: September 14, 1995 Subject: Almond Drive Street Improvements A question was raised at the September 6 City Council Meeting regarding the digouts in Almond Drive after the contractor had paved the street. After the street had been paved, our Public Works Inspector reviewed the work and found, in addition to the normal manhole and water valve adjustments, two areas where the asphalt had cracked because of unstable subgrade. The contractor dug out these areas, recompacted the subgrade and placed a thicker section of asphalt to increase the strength of the pavement over these areas. While repairing these areas, the contractor found a third section that he also repaired. All this repair work was done by the contractor at his expense. This area amounted to approximately 75 square feet out of a total of 20,300 square feet of reconstructed street. While this is a small amount, we strive to have none of this type of corrective work.
