AGENDA TITLE: Consider Awarding Abandoned Vehicle Towing Franchise

RECOMMENDED ACTION: That the City Council consider awarding the Abandoned Vehicle Towing
Franchise to Stubbs Pro Tow.
BACKGROUND INFORMATION: For the last several years the towing of vehicles pursuant to Lodi
Municipal Code Section 10.56.020 (i.e. removal from private
property) has been subject to an exclusive franchise agreement with Stubbs Pro Tow. This exclusive
franchise was needed for several reasons. First, when salvage prices were low it would be difficult to find
a towing company willing to pick up and dispose of junk autos at no cost to the City. Second, when the
various vendors were busy there would be long delays before the vehicles were removed. Third, when
the vehicles to be picked up were of little or no value, it would be difficult to find a company willing to
tow the vehicle away and dispose of it. Stubbs has performed this service no matter what the situation
and always in a timely manner.
Currently, there are several companies interested in providing this service to the City. The Police Chief
and Community Development Director believe that the award should go to Stubbs Pro Tow because (1)
the company has an outstanding track record with the City; (2) Stubbs has a large variety of towing
equipment which is essential in abandoned automobile removal; and (3) the Company is also a Licensed
Automobile Dismantler which is an advantage to the City.

RE: Request for Proposal
The following proposal for removal,disposal and dismantling of
vehicles is made as follows by Pacific Towing.
1. Pacific Towing will remove all abandoned,wrecked,dismantled or
inoperative vehicles at their own expense, no longer than 72
hours after directed to by the City of Lodi.
2. Store all vehicles at 1533 S. Stockton St, Lodi, Ca. for a
period of no longer than 45 days for the purpose of conducting
a lien sale.
3. All vehicles will be transported at the end of the lien sale to
Pick -N -Pull Auto Parts at 3927 Clark Dr., Stockton, Ca., dismantler
#4215, where they will dispose of vehicles.
4. Pacific Towing agrees to pay the City of Lodi the sum of $12.50
per vehicle towed payable on the 15th of each month.
5. All records shall be kept at 1533 S. Stockton St., Lodi, Ca.
6. Pacific Towing will provide all necessary equipment (Tow Trucks,
Slidebacks, Trailers) to remove all parts of said vehicles to
be removed.

A PAUUMT
We would like to propose to the City of Lodi that Plummer Towing
will remove all abandoned cars, wrecked or otherwise, at no
cost to the city.
Plummer Towing would be willing to do this on an exclusive
contract with the City and Plummer Towing, or on a rotation
basis with other companies, under the city's direction.

We will pick these vehicles up in an expediant manner, as
outlined in the contract, or by whatever terms the City of Lodi
proposes. These vehicles will be held in our yard the legal
lenght of time, as dictated by the California Vehicle Code (CVC),
and then they will be disposed of to a licensed auto dis-
mantler.
Plummer Towing is bidding this contract, noting that we protest
in the contract that the towing company be a "duly licensed
auto dismantler to tow under contract." Under the CVC, we
understand that all abandoned vehicles have to go to a licensed
auto dismantler or scrap iron dealer to be disposed of, after
the legal waiting period.
We also protest to the wording of "all wrecked vehicles within
the city limits on public and private property."
We welcome the opportunity to obtain this contract with the
City of Lodi.

Stubb's Towing has been providing Lodi Fire Department with cars
for our auto extrication training for over 10 years.
These vehicle have been used for auto extrication training for
our recruit academy as well as annual training for all members of
the department. This training has enabled us to be more
proficient in extricating trapped victims in vehicle crashes.
Stubb's Towing has provided us with a variety of makes and
models. This allows us to train on the construction features
that are unique to certain brands of vehicles.
Stubb's Towing has always been willing to provide us with these
vehicles. They deliver and remove these vehicles to our drill
ground at no cost to the City.
This service has been greatly appreciated by the Lodi Fire
Department administration.

To many times things get away from us, this was one of those times. I was reviewing our
training records and found were your company has repeatedly assisted Mokelumne Rural Fire
District with vehicles at no charge for the purpose of extrication training.
As you know a large part of our responses are to motor vehicle accidents, a great deal
of training and skills must go into the removal of an Injured victim from a car when is bent,
broken and entangled around them.

Guthrie responded to a plea made
in the December issue of The Square
News for a pickup that could be used
on site and around town. The grey
pickup will have our logo painted on
the doors and should be on the
streets within a matter of weeks.

A RESOLUTION OF THE LODI CITY COUNCIL
AWARDING THE BID FOR ABANDONED VEHICLE TOWING FRANCHISE
WHEREAS, in answer to notice duly published in accordance with law and the order of
this City Council, sealed bids were received and publicly opened on April 17, 1995 at 11:00 a.m.
for the bid for Abandoned Vehicle Towing Franchise, described in the specifications therefor
approved by the City Council in February, 1995; and
WHEREAS, said bids have been compared, checked, and tabulated and a report thereof
filed with the City Manager as follows:

Pacific Towing Stockton Action within 72 hours after order.
Storage maximum 45 days. Cost $12.50
per vehicle paid to the City on 15th of
each month.
Stubbs Pro Tow Lodi
No cost to City, action within 48 hours
after order.
WHEREAS, it is staff recommendation to accept the bid of Stubbs Pro Tow at no cost to
the City for a period of two (2) years; and
NOW, THEREFORE, BE IT RESOLVED by the Lodi City Council that award
of the bid for Abandoned Vehicle Towing Franchise be and the same is hereby awarded to
Stubbs Pro Tow of Lodi, California for a period of two (2) years.
