HomeMy WebLinkAboutAgenda Report - March 15, 1995 (54)� OF CITY OF LODI COUNCIL COMMUNICATION cq��FOA��P AGENDA TITLE: Program Supplement to Local Agency -State Agreement No. 5154 for Street Lighting, Various Locations MEETING DATE: March 15, 1995 PREPARED BY: Public Works Director RECOMMENDED ACTION: That the City Council adopt a resolution approving Program Supplement No. 037 to the Local Agency -State Agreement No. 5154 for street lighting at various locations throughout the City. BACKGROUND INFORMATION: Last year, the City was informed it was successful in obtaining Federal Hazard Elimination/Safety (HES) funds to install street lighting on various arterial and collector streets. This Federal program covers one hundred percent of the cost of preliminary engineering, construction and construction engineering. However, there will be some minor ineligible expenses the City will have to cover. Our application requested $289,000 for the project on the arterial and collector streets and all indications were that was the amount we would receive. When the Program Supplement arrived, it showed an estimated project cost and Federal funding amount of $280,000. When Caltrans was asked about the discrepancy between the amount requested in our application and the Program Supplement, they said there had been a typographical error in the programmed amount at the Federal level. They indicated we could request the programmed amount and Program Supplement be changed; however, because the HES funds are over programmed by approximately twenty-five percent, the delay might jeopardize the entire amount. Their suggestion was that we go to bid and, after the bids are received, decide what we want to do. If the bids are more than the programmed amount, we can request additional funding. Since the shortfall is only three percent of the total amount requested, there is a good chance we may get it. If we can't get the funding needed to complete the entire project, we could downsize the contract by eliminating some of the lighting. It is our recommendation the Program Supplement be approved. We intend to go to bid as soon as we receive notification the Federal funds have been obligated. At the time a contract is awarded, a decision can be made on how to proceed if additional funds are needed. FUNDING: Not applicable. L. The Local Agency further stipulates that as a condition to payment of funds obligated to this project, it accepts and will comply with the covenants or remarks setforth on the following pages. All maintenance, involving the physical condition and the operation of the improvements, referred to in Article VI MAINTENANCE of the aforementioned Master Agreement will be performed by the Local Agency at regular intervals or as required for efficient operation of the completed improvements. 2. The Local Agency will advertise, award, and administer this project and will obtain the State's concurrence prior to either award or rejection of the contract. 3. The Local Agency agrees the payment of Federal funds will be limited to the amounts approved by the Federal Highway Administration in the Federal -Aid Project Agreement (PR-2)/Detail Estimate, or its modification (PR -2A) or the FNM -76, and accepts any increases in Local Agency Funds as shown on the Finance or Bid Letter or its modification as prepared by the Division of Local Streets and Roads. 4. In executing this Program Supplemental Agreement, Local Agency hereby reaffirms the "Nondiscrimination Assurances" contained in the aforementioned Master Agreement for Federal -Aid Program. 5. Whenever the local agency uses a consultant on a cost plus basis, the local agency is required to submit a post audit report cover- ing the allowability of cost payments for each individual consul- tant or sub -contractor incurring over $25,000 on the project. The audit report must state the applicable cost principles utili- zed by the auditor in determining allowable costs as referenced in CFR 49, part 18, Subpart C - 22, Allowable Costs. Page 2 of 2 RESOLUTION NO. 95-35 A RESOLUTION OF THE LODI CITY COUNCIL APPROVING CALTRANS SUPPLEMENT NO. 037 TO LOCAL AGENCY -STATE AGREEMENT FOR STREET LIGHTING, VARIOUS LOCATIONS RESOLVED, that the City Council of the City of Lodi does hereby approve Program Supplement No. 037 to the Local Agency/State Agreement with the Department of Transportation for the installation of street lighting at various locations. BE IT FURTHER RESOLVED, that the City Council of the City of Lodi does hereby authorize the City Manager and City clerk to execute the subject document on behalf of the City of Lodi.
