BACKGROUND INFORMATION: Improvements in Johnson Ranch, Unit No. 3, Tract No. 2587, have been completed in substantial conformance with the requirements of the Subdivision Agreement between the City of Lodi and Lodi Homebuilders, L.P., dated July 22, 1994. The streets to be accepted are as follows: Streets Length in Miles Condor Court 0.06 Hummingbird Drive 0.07 Mockingbird Drive 0.13 Seahawk Lane 0.05 Starling Way 0.03 Turtledove Court 0.06 Total New Miles of City Streets 0.4 _ FUNDING: Not applicable. PETERSON recycled paper City Manager CACCEPT.DOC 01124MSC-1 RESOLUTION NO. 95-13 -------------------- -------------------- A RESOLUTION OF THE LODI CITY COUNCIL ACCEPTING THE DEVELOPMENT IMPROVEMENTS INCLUDED IN THE IMPROVEMENT AGREEMENT FOR JOHNSON RANCH, UNIT NO. 3, TRACT NO. 2587 The City Council of the City of Lodi finds: 1. That all requirements of the Improvement Agreement between the City of Lodi and Lodi Homebuilders, L.P., for the improvements for Johnson Ranch, Unit 3, Tract No. 2587, have been substantially complied with. The improvements are shown on Drawings Nos. 92D038, 92D039, 92D044 through 92D048 and 94D038, on file in the Public Works Department, and as specifically set forth in the plans and specifications approved by the City Council on July 20, 1994. 2. PERRIN City Clerk BOB McNATT City Attorney The City Council of the City of Lodi, at its meeting on Wednesday, February 1, 1995, accepted the public improvements that were made in the subject project. Enclosed for your files is a copy of the resolution accepting the public improvements. From the date of the resolution, the City of Lodi will maintain the street and other public improvements installed within rights-of-way and public utility easements as shown on the approved plans. A copy of this letter will be sent to your bonding agency in order that the bond covering faithful performance can be exonerated. The bond covering labor and materials will have to remain in effect for a period of ninety days from the date of the resolution in conformance with State law. The bond covering labor and materials must remain in effect until May 2, 1995 in conformance with the requirements of State law. You will receive no further correspondence regarding the release of the bond for labor and materials unless a claim is filed.
