($367,221.00) MEETING DATE: June 6, 2001 SUBMITTED BY: Electric Utility Director RECOMMENDED ACTION: That the City Council award the contract for installation of streetlights on Streetlight Completion Project Phase 2 to the low bidder, Tim Paxin's Pacific Excavation, Inc. in the amount of $367,221.00. BACKGROUND INFORMATION: On May 1, 2001, eight bids were received and opened for this project. The involved streets are shown darkened within the circles on the attached map. It is estimated that the Streetlight Completion Project, when completed, will have installed 1,000 - 1,200 lights during the next 3 - 5 years. Plans and Specifications for this project were approved by the City Council at the meeting of March 21, 2001. During the bidding process, one addendum was issued. In order to be considered a qualified bidder a prospective bidder was required to return a signed acknowledgement indicating receipt of the addendum or include such acknowledgement with the bid. One bidder did not submit the acknowledgement. The addenda were mailed via FedEx. Fed Ex's records indicate delivery of the addendum to Summit Electrical Construction. HAYS =;City Attorney This letter provides formal notification to you of the plan by City of Lodi staff to recommend that the Lodi City Council award the bid for 25,000 feet of #1/0 and 24,000 feet of #350 600V underground triplex to the second -low bidder, Western States Electric, instead of the low bidder, Nexans Energy USA, Inc. The reasons for the recommendation are as follows: 1) The 24 -week leadtime indicated on the proposal would delay installations at several subdivisions which are planned for this summer. Second -low bidder quoted a leadtime of four to six weeks; other bidders quoted two to seven -week leadtimes. The "Information to Bidders" section of the bid instructions, subsection entitled "Delivery", indicates that "delivery time will be part of the bid evaluation." Staff has determined that the cost of delay of the projects would exceed the increase in cost of award to the second -low bidder, and that it is in the City's best interest to obtain timely delivery. 2) The exceptions taken on Item #2, i.e., Full hard conductor instead of % to'/ hard as specified, No sequential footage markings instead of sequential footage markings every two feet, as specked, and No wood lagging instead of wood lagging on the reels, as specified, are not acceptable to the Engineering Division of the Electric Utility Department. If you do not agree with staffs recommendation to award to the second -low bidder, and believe that the City should award to you, points 1) and 2) above notwithstanding, you may file a letter of protest with the City of Lodi. Your letter should indicate why you believe the City should award to you, and it should address the issues of leadtime and exceptions to the specifications. Nexans Energy USA, Inc.
