AGENDA TITLE: Authorize the City Manager to Execute a Professional Services Agreement with Padilla &
Associates for Disadvantaged Business Enterprise (DBE) Program Consulting Services ($6,500)

RECOMMENDED ACTION: That the City Council authorize staff to hire the consulting services of Padilla &
Associates, Inc. to update the City of Lodi's comprehensive Federal Disadvantaged
Business Enterprise (DBE) Program and Overall Annual Goal for Federal Fiscal Year
2001102.
BACKGROUND INFORMATION: The U.S. Department of Transportation (DOT) published a significant New Rule
(49CFR, Part 26) revising the Federal DBE Program to ensure fair competition for
all DOT contracts. The new regulations are intended to ensure a level playing field
on which minority, women and other disadvantaged small businesses can compete
for federally -assisted highway, transit and airport contracts. These regulations require the City of Lodi to submit a
DBE program and Overall Annual Goal that meets the new regulations as a condition of using FHWA and FTA. The
new year's program must be submitted in June, 2001, for the year October 1, 2001 through September 30, 2002.
Padilla & Associates were hired to develop the DBE Program and goals for last Federal fiscal year. The new
Program requires that an overall goal be re-established and each project which uses federal funds must have its own
specific goal. The consultant will prepare the overall annual DBE Goal for FFY 2001102 utilizing 49CFR Part 26 goal
setting methodology, including calculation of the base figure and required analysis; determine the City's race -neutral
and race -conscious participation projections and corresponding rationale towards meeting the overall annual goal;
and prepare required submissions to Caltrans. They will also develop the required public notice compile public
facilitation summary for submission to Caltrans.
