A RESOLUTION OF THE LODI CITY COUNCIL ACCEPTING
GATEWAY SOUTH SUBDIVISION, UNIT NO. 3, TRACT NO. 4079; AND
FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE THE
IMPROVEMENT DEFERRAL AGREEMENT FOR THE
GATEWAY SOUTH NEIGHBORHOOD PARK IMPROVEMENTS
WHEREAS, Gateway South Subdivision, Unit No. 3, is the third phase of a multi -phase
residential development located west of Lower Sacramento Road and south of
Century Boulevard, and consists of 48 single-family residential lots; and
WHEREAS, as part of the terms of the improvement agreement for the subdivision, the
developer, KDK Land Company, is required to execute a separate improvement agreement to
construct the neighborhood park in the Gateway South subdivision; and
WHEREAS, due to the timing of various design issues, the developer is requesting to
execute an improvement deferral agreement in lieu of the improvement agreement that will
allow the developer to defer and complete the park construction by December 31, 2024; and
WHEREAS, the developer has furnished the City with the necessary bond, fees, and
signed agreement for the deferred park improvements; and
WHEREAS, staff recommends accepting Gateway South Subdivision, Unit No. 3,
Tract No. 4079; and
WHEREAS, staff further recommends authorizing the City Manager to execute the
improvement deferral agreement for the Gateway South neighborhood park improvements.
NOW, THEREFORE, BE IT RESOLVED that the Lodi City Council does hereby accept
Gateway South Subdivision, Unit No. 3, Tract No. 4079; and
BE IT FURTHER RESOLVED that the Lodi City Council does hereby authorize the
City Manager to execute the improvement deferral agreement for the Gateway South
neighborhood park improvements; and
BE IT FURTHER RESOLVED, pursuant to Section 6.3q of the City Council Protocol
Manual (Res. No. 2019-223), the City Attorney is hereby authorized to make minor revisions to
the above -referenced document(s) that do not alter the compensation or term, and to make
clerical corrections as necessary.
