HomeMy WebLinkAboutResolutions - No. 2023-250RESOLUTION NO. 2023-250 A RESOLUTION OF THE LODI CITY COUNCIL AMENDING THE MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF LODI AND THE LODI PROFESSIONAL FIREFIGHTERS ASSOCIATION THROUGH A SIDE -LETTER AGREEMENT ADDING OVERTIME PAY FOR IN-PERSON PARAMEDIC INSTRUCTION WHEN OFF-DUTY WHEREAS, the Lodi City Council approved a successor Memorandum of Understanding ("MOU") with the Lodi Professional Firefighters (LPF) that has a term of January 1, 2023 through December 31, 2025; and WHEREAS, the Lodi Fire Department will be improving services to the Lodi citizens by providing Advanced Life Support (ALS) instead of Basic Life Support (BLS), requiring Fire Department personnel to be licensed and certified Paramedics; and WHEREAS, the Fire Department received a grant from Assistance to Firefighters Grant ("AFG") to fund Fire Department personnel to attend Paramedic training and to backfill absent Firefighters when attending instruction during on -duty hours; and WHEREAS, the LPF MOU does not provide for overtime compensation to attend in-person Paramedic instruction during off duty hours; and WHEREAS, the City and LPF wish to enter into a side -letter agreement amending the LPF MOU to provide LPF members with overtime compensation to attend in-person Paramedic instruction during off-duty hours; and WHEREAS, it is recommended that Council approve the revisions to the MOU with LPF through a Side -Letter Agreement to provide overtime compensation to LPF members attending in-person paramedic instruction during off-duty hours. NOW, THEREFORE, BE IT RESOLVED that the Lodi City Council does hereby approve the attached Side -Letter Agreement (Exhibit A) between the City of Lodi and LPF adding overtime compensation to attend in-person Paramedic instruction during off-duty hours. This Side -Letter Agreement does not affect any other training programs and expires upon exhaustion of available grant funding; and BE IT FURTHER RESOLVED, pursuant to Section 6.3q of the City Council Protocol Manual (adopted 11/6/19, Resolution No. 2019-223), the City Attorney is hereby authorized to make minor revisions to the above -referenced document(s) that do not alter the compensation or term, and to make clerical corrections as necessary. Date: November 1, 2023 ------------------------------------------------------------------------ ------------------------------------------------------------------------ I hereby certify that Resolution No. 2023-250 was passed and adopted by the Lodi City Council in a regular meeting held November 1, 2023, by the following vote: AYES: COUNCIL MEMBERS — Bregman, Craig, Nakanishi, Yepez, and Mayor Hothi NOES: COUNCIL MEMBERS — None ABSENT: COUNCIL MEMBERS — None ABSTAIN: COUNCIL MEMBERS — None OLIVIA NASHED City Clerk 2023-250 Exhibit A Side Letter Agreement Amending the Memorandums of Understanding Between the City of Lodi and the Lodi Professional Firefighters January 1, 2023 — December 31, 2025 This Side Letter Agreement ("Agreement") is entered into between the City of Lodi, a municipal corporation ("City"), and Lodi Professional Firefighters ("LPF"), and is effective as of [DATE]. RECITALS WHEREAS, the Memorandum of Understanding between LPF and the City term runs from January 1, 2023, through December 31, 2025 ("MOU"), and WHEREAS, the Lodi Fire Department applied for and received a grant from Assistance to Firefighters Grant ("AFG") to fund Paramedic Training for Lodi Fire Department personnel; and WHEREAS, several members of the Lodi Fire Department have voluntarily enrolled in Paramedic training; and WHEREAS, the AFG grant funding pays for the cost of the Paramedic Training program and all associated overtime for backfilling the absent employee position; and WHEREAS, LPF personnel who attend training on regularly scheduled work days are compensated at their regular rate of pay; however, they are not compensated for training on off- duty days; and WHEREAS, representatives from the City and LPF have met and conferred in good faith to discuss paying overtime to employees who are attending in-person Paramedic Training on their off-duty days; and WHEREAS, the AFG grant allows payment for attending all Paramedic Training days; and WHEREAS, this Agreement does not affect any other training programs, nor will the City or Fire Department compensate employees to attend other voluntary training on their off-duty days; and WHEREAS, the Fire Chief has the sole discretion on limiting the number of employees who are enrolled in the AFG grant funded Paramedic Training program at one time for operational and staffing needs; and NOW, THEREFORE, the parties hereto, agree as follows: the City shall pay Lodi Fire Department employees overtime for their hours of in-person instruction (classroom, clinical, and internship) of Paramedic Training on their scheduled off-duty days, retro -active to the beginning of the Paramedic Training program on July 11, 2023. The City shall make these payments with AFG grant funds, until the AFG grant funds have been exhausted, expiration of the AFG grant, or completion of the Paramedic Training program, whichever occurs first. The City is only obligated to use AFG grant funds under this Agreement, and will not utilize funds from any other source to make the requested overtime payments for Paramedic Training on their off-duty days. All other MOU terms and conditions not otherwise modified in this Agreement shall remain unchanged and in full force and effect through December 31, 2025.
