HomeMy WebLinkAboutAgenda Report - April 18, 2001 E-12CITY OF LODI COUNCIL COMMUNICATION AGENDA TITLE: Authorize City Manager to Execute Lease Agreement with BroadLink Communications, Inc., for the Purpose of Installing a Small Equipment Building on City Property and Erecting Antenna on the City's Elevated Water Tank at 114 North Main Street MEETING DATE: April 18, 2001 PREPARED BY: Public Works Director RECOMMENDED ACTION: That the City Council authorize the City Manager to execute a lease agreement with Broadl-ink Communications, Inc., for the purpose of installing a small equipment building on City property and erecting antenna on the City's elevated water tank. BACKGROUND INFORMATION: A representative for BroadLink Communications recently approached the City about placing antenna on the water tower on Main Street. There are two existing leases for the use of the water tower; however, those leases allow other providers to use the tower provided there is no interference with the other tenants' use. The Broadlink antenna will be located above the existing equipment on the very top of the tower (Exhibit A). Their ground equipment will be located northeast of the tower, immediately west of the RCS equipment inside the fenced area (Exhibit B). The terms of the lease with Broadlink are the same as the most recent communication leases. BroadLink will pay the City a $2,500 processing fee, $900 per month rent with an escalation clause, and post a $25,000 performance bond. The performance bond is a new requirement of our leases for communication equipment. They will also be responsible for their pro rata share of the costs to improve the Main Street site frontage, i.e., new sidewalk, fencing or landscaping, at the appropriate time. Broadlink will take out a building permit and satisfy any structural or code requirements regarding attachments to the tower. FUNDING: Lease will provide the City with an additional General Fund revenue of $10,800 per year. Presently, revenue from one of the other leases goes to Water Fund and one to General Fund.
