A RESOLUTION OF THE LODI CITY COUNCIL PARTIALLY ACCEPTING
LUMINA SUBDIVISION, UNIT NO. 1 (TRACT NO. 4121) PUBLIC
IMPROVEMENTS; AND AMENDING TRAFFIC RESOLUTION NO. 97-148 BY
APPROVING A TWO-WAY STOP CONTROL ON AMARONE DRIVE AT
LABRUSCA DRIVE AND A MULTI -WAY STOP CONTROL AT
LABRUSCA DRIVE AND KORDIA AVENUE
WHEREAS, Lumina Subdivision, Unit No. 1, is the first phase of a two-phase residential
development located west of Stockton Street and south of Harney Lane, and consists of 67
single-family residential lots; and
WHEREAS, the improvement agreement for the project, approved by Council on
ALgust 3, 2022, requires the installation of street frontage improvements fronting
Stockton Street, all interior subdivision public improvements, and a portion of the neighbor park
improvements adjacent to Unit 1; and
WHEREAS, the developer, RR 150 Lots, LLC, has completed all public improvements
apart from the backfill of park land, 10 -foot wide concrete path along the western subdivision
boundary, landscape and irrigation between the masonry wall and concrete path, and storm
basin outfall structure; and
WHEREAS, all required improvements submitted for partial acceptance have been
co-istructed in accordance with the approved improvement plans and City Standards; and
WHEREAS, in accordance with the Subdivision Map Act Section 66499.7(d), the
remaining public improvements are less than 20 percent of the overall subdivision
imorovements; and
WHEREAS, approximately 0.52 miles of new interior streets will be accepted with this
partial acceptance; and
WHEREAS, the developer is requesting that the City approve partial acceptance of the
subdivision to allow home occupancy within the subdivision. Staff recommends the proposed
partial acceptance with the following conditions:
1. Maintain a security on remaining work in accordance with the Subdivision Map Act
requirements.
2. Provide a warranty bond equal to 10 percent of the value of the accepted improvements.
This new warranty bond shall cover all the public improvements for two years from the
date of partial acceptance. Prior to final acceptance, a separate warranty bond shall be
provided to cover all of the Unit 1 public improvements for two years from the date of final
acceptance by the City Council as outlined in the original improvement agreement and
approved subdivision plans. Also prior to final acceptance, a separate landscape
maintenance bond equal to 10 percent of the value of all of the Unit 1 public landscaping
system improvements shall be provided. This maintenance bond shall cover all the public
landscaping improvements for three years from the date of final acceptance by the
City Council as outlined in the original improvement agreement and approved subdivision
plans.
3. Payment of $11,339 for the partial project acceptance fee.
4. No more than 50 homes will be allowed to be final/occupied prior to the final acceptance of
the subdivision improvements.
WHEREAS, staff recommends partially accepting Lumina Subdivision, Unit No. 1 (Tract
No. 4121); and
WHEREAS, staff further recommends amending Traffic Resolution No. 97-148 by
approving a two-way stop control on Amarone Drive at Labrusca Drive and a multi -way stop
co,itrol at Labrusca Drive and Kordia Avenue.
NOW, THEREFORE, BE IT RESOLVED that the Lodi City Council does hereby partially
accept Lumina Subdivision, Unit No. 1 (Tract No. 4121) public improvements, with the
co-iditions as set forth above; and
BE IT FURTHER RESOLVED that the Lodi City Council does hereby approve the
amendment of Traffic Resolution No. 97-148 by approving a two-way stop control on
Amarone Drive at Labrusca Drive and a multi -way stop control at Labrusca Drive and
Kordia Avenue; and
BE IT FURTHER RESOLVED, pursuant to Section 6.3q of the City Council Protocol
Manual (Res. No. 2019-223), the City Attorney is hereby authorized to make minor revisions to
the above -referenced document(s) that do not alter the compensation or term, and to make
clerical corrections as necessary.
