A RESOLUTION OF THE LODI CITY COUNCIL AUTHORIZING THE
CITY MANAGER TO WAIVE THE BID PROCESS AND EXECUTE A
PROFESSIONAL SERVICES AGREEMENT WITH GARLAND/DBS, INC., OF
CLEVELAND, OHIO, FOR MUNICIPAL UTILITIES SERVICES ADMINISTRATION
BUILDING ROOF REPAIR PROJECT, UTILIZING U.S. COMMUNITIES
CONTRACT NO. PW1925; AND FURTHER APPROPRIATING FUNDS
WHEREAS, the MUS administration building, located at 1331 South Ham Lane, was
constructed in 1971 with a built-up composition roof, which was last repaired in 2000 with a
single -ply roofing system. The roof has developed small leaks and the single -ply material is
showing signs of deterioration and should be repaired to avoid water damage to the building
interior. This project will replace the existing roof with a two-ply membrane system and new
metal flashing system; and
WHEREAS, per LMC Section 3.20.045, State and Local Contracts, the bidding process
may be waived when advantageous for the City, with appropriate approval by the City Manager
and City Council, to use contracts that have been awarded by other California public agencies,
provided the award was in compliance with their formally -adopted bidding or negotiating
procedures; and
WHEREAS, staff recommends authorizing the City Manager to waive the bid process
and execute a Professional Services Agreement with Garland/DBS, Inc., of Cleveland, Ohio, for
the MUS Administration Building Roof Repair Project, in the amount of $201,949, utilizing U.S.
Communities Contract No. PW1925; and
WHEREAS, staff further recommends appropriating funds in the amount of $20,000 to
Water Capital (56199000.77020) and $20,000 to Wastewater Capital (53199000.77020).
NOW, THEREFORE, BE IT RESOLVED that the Lodi City Council does hereby
authorize the City Manager to waive the bid process and execute a Professional Services
Agreement with Garland/DBS, Inc., of Cleveland, Ohio, for the MUS Administration Building
Roof Repair Project, in the amount of $201,949, utilizing U.S. Communities Contract
No. PW1925; and
BE IT FURTHER RESOLVED that the Lodi City Council does hereby appropriate funds
in the amount of $40,000 as set forth above; and
BE IT FURTHER RESOLVED, pursuant to Section 6.3q of the City Council Protocol
Manual (adopted 11/6/19, Resolution No. 2019-223), the City Attorney is hereby authorized to
make minor revisions to the above -referenced document(s) that do not alter the compensation
or term, and to make clerical corrections as necessary.
