Rates Pursuant to Proposition 218 for Residential Customers

solid waste rates pursuant to Proposition 218 for residential customers.
BACKGROUND INFORMATION: CalRecycle has adopted regulations consistent with the mandates
associated with Senate Bill 1383. The mandates are designed to achieve
the organic waste reduction goals established in Section 39730.6 of the
Health and Safety Code through a 50 percent reduction in the level of statewide disposal of organic waste from
the 2014 level by 2020; and a 75 percent reduction in the level of statewide disposal of organic waste from the
2014 level by 2025. This is an unfunded State mandate.
The City is required to comply with these regulations to assist the State in achieving the organic waste
reduction levels outlined above. The main requirements resulting from the regulations include the adoption of
an enforcement ordinance, implementation of mandatory residential and commercial food waste collection, and
education and outreach. Jurisdictions are required to implement SB 1383 by January 1, 2022. At the February
16, 2022 meeting, Council adopted the Notice of Intent to Comply (NOIC). By filing the NOIC, CalRecycle is
authorized to waive civil penalties until January 1, 2023 if a jurisdiction intends to comply with the SB1383
requirements. On March 2, 2022, Council introduced an ordinance amending the Lodi Municipal Code Title 13
"Public Health Services," which allows the City to enforce SB1383 requirements on business and residents
beginning January 1, 2024.
Staff is currently working with Waste Management to provide substantial outreach to our customers regarding
organics recycling requirements with residential organics recycling service to commence by April 1, 2023.
Staff is also working with Waste Management on a proposed contract extension that will incorporate the new
SB 1383 requirements. Proposed rate schedules and information were supplied to the City Council at the
January 17, 2023 Shirtsleeve meeting prior to mailing Proposition 218 protest hearing notices (English and
Spanish translations) and preliminary to a public hearing to consider adopting the proposed rate schedules for
the period from April 1, 2023 through March 31, 2028. The rate schedules set maximum limits on the solid
waste rates for the next five years, and each year the City Council will be requested to approve the actual rates
to be implemented. At the public hearing on March 15, 2023, the City Council will be asked to receive public
comment; adopt resolutions setting future adjustments to solid waste rates with limits for the period April 1,
2023 through March 31, 2028.
At the March 15, 2023 Council Meeting, staff conducted a Public Hearing to consider adopting a resolution
setting future solid waste rates pursuant to Proposition 218 for residential customers. The Public Works
Director presented information regarding proposed rates for solid waste to Council and the public in
attendance. The public hearing was opened and 13 members of the public spoke on the subject. Council
members commented and asked questions of Public Works and Waste Management staff. Mayor Hothi called
for any last protests prior to closing the public hearing. Once the public hearing was closed, staff tallied

potential protests in accordance with Proposition 218, and announced 369 protests were received. Council
voted to continue the matter for discussion and further action until April 5, 2023.
In response to Council direction, staff and Waste Management propose to provide low volume, 35 gallon
service to the first 1,000 customers that sign up between May 8, 2023 and May 12, 2023. The low volume 35
gallon rate is only available to customers that have a 35 gallon cart as of April 5, 2023. Staff and Waste
Management will provide outreach regarding eligibility requirements from April 6, 2023 through May 12, 2023.
To accommodate the low volume 35 gallon rate outreach and sign up timeline, staff and Waste Management
propose the new rates for all customers be implemented on May 15, 2023.
FISCAL IMPACT Rate adjustments are needed in order to fund the State mandates of
Senate Bill 1383.

PUBLIC HEARING FOR
• ' REFUSE RATE ADJUSTMENT EFFECTIVE APRIL 1, 2023
NOTICE IS HEREBY GIVEN that the Lodi City Council will consider a proposed solid waste rate
increase at a public hearing at 7:00 p.m. on Wednesday, March 15, 2023 at the Carnegie Forum, 305
West Pine Street, Lodi, CA 95420. The City Council shall consider adoption of a trash collection and
recycling rate schedule for residential services to take effect April 1, 2023, as set forth in Table 1 below.
Explanation of Need for Proposed Rate Increase
Senate Bill 1383, signed by Governor Brown in 2016, mandates organic waste be recycled to reduce
short-lived climate pollutants and greenhouse gas (GHG) emissions in landfills. Organic waste, which
includes food waste, food -soiled paper, and landscape trimmings, makes up a significant portion of
California's waste stream and produces methane, a greenhouse gas with over 80 times the heat -trapping
effect of carbon dioxide. The City's new program aims to keep organic waste out of landfills and instead,
turn it into compost to be offered to local agricultural users and landscapers to meet the State's goals to
reduce organic waste disposal by 75 percent by 2025. Failure by the City to comply with the state law
can result in penalties of up to $10,000 per day.
What does this mean for customers?
SB 1383 requires residents to separate organic waste from their garbage. Residents will be able to
dispose of organic waste in their existing yard waste/green waste container. However, collection service
for this container must be completed weekly instead of bi-weekly (every other week) to minimize
potential odors and enhance quality of service.
Rate Increase to Fund the Additional Service
City Staff is proposing an increase in residential rates to cover the reasonable cost of additional services
provided for the change to weekly organic waste collection service, including the increased processing
fees for the combined organics stream of yard waste and food waste, additional vehicles and staff
required to carry out and operate the new program, and a cart resizing plan (described below). The
proposed rate increase will allow the City to comply with Senate Bill 1383 and California's recycling and
GHG emissions reduction goals.
Basis of the Rate Increase
The proposed rates listed in Table 1 below reflect the initial rates for each container size for services to be
provided by USA Waste of California, Inc. ("WM") in accordance with the terms of WM's franchise
agreement with the City. The proposed rate schedule will increase average residential rates by no more
than $5.00 per month for the first year. Beginning one year after the effective date of the new rates and
annually thereafter, residential and commercial rates will be indexed at 80% of the annual change in the
Consumer Price Index, ,for all Urban Consumers for San Francisco -Oakland -San Jose, California Area,
All Items (1982-84+100) as published by the United States Department of Labor, Bureau of Labor
Statistics (CPI -U) for the twelve (12) month period ending December 31 of the preceding calendar year
plus an adjustment for extraordinary increases in landfill fees, fuel and energy costs, and changes in law.
Rate Affordability Cart Re -sizing Plan
In an effort to meet state GHG reduction requirements, WM has provided a plan to (1) reduce organic
waste contamination from overfilled smaller carts, and (2) make the increased service requirements more
efficient with standardized cart sizes, which will also allow more affordable rates for the larger size carts
(64 gallon and 96 gallon).
Under this plan, residents that currently have a 20 gallon or 35 gallon size cart will see the proposed
monthly increase of $5.00 per month for the first year. These residents will be automatically transitioned
to a 64 gallon cart in the first year and their previous smaller cart will be removed by WM. The rate for
these customers will be incrementally adjusted over the subsequent three-year period (ending April 1,
2026),plus the annual CPI rate adjustments (unless an extraordinary circumstance requires an adjustment
as allowed under the WM franchise agreement). Additionally, the proposed new, incrementally adjusted
rates for customers migrating from 20 or 35 gallon carts to 64 gallon carts will not exceed the monthly
rate of the 64 gallon standard rate at any time.
Proposed Increases to Refuse Rates
The proposed rates in Table 1 were calculated using proprietary data from WM to determine the
reasonable relationship of the costs for services provided for each container size as required under the SB
1383 organic service requirements. WM's cost analysis also included the additional funding necessary for
the City of Lodi to perform the downtown and street maintenance required to address the impacts of the
additional SB 1383 collection services as listed below:
• Purchase of two additional collection vehicles to increase organics collection to weekly service;
• Implement Smart Truck technology for SB 1383 route reviews and contamination monitoring;
• Outreach and education materials required by SB 1383;
• SB 1383 required cart labeling redesign and new carts;
• Funding for City staff to implement SB 1383 programs;
• Funding for City street maintenance in response to the additional truck traffic required for weekly
organic collection;
• Funding to the City for downtown maintenance related to additional collection services; and
• Funding to the City for the administration of the first four years of the contract

Explanation of the Proposition 218 Protest Process
Proposition 218 requires that the City provide a notice of the proposed future rate schedule to all property
owners at least forty-five (45) days prior to holding a public hearing by the City Council to consider
adoption of the increased rates. If a majority of the property owners or renters who pay the utility bill file
a written protest with the City Clerk opposing the rate increase prior to the end of the public hearing, the
increase will not take effect.
How to File a Protest
To submit a written protest opposing the proposed rate schedule, the property owner or renter must
include a description of their relevant property sufficient to identify the property. This description can be
the address or assessor's parcel number for the relevant property, which is shown on this mailing.
If the name of the protesting party is not shown on the last equalized assessment roll of San Joaquin
County as the owner of the property or on the utility account, the signer of the Protest must also submit
written evidence of ownership or renter ship and utility bill responsibility.
At the public hearing, the City Council shall hear all protests and tabulate all submitted ballots in
accordance with Section 6 of Article XIII D of the California Constitution. Only one written protest per
parcel filed by the owner or tenant (paying the utility bill) shall be counted in calculating whether there is
a majority protest. If there are multiple votes for a single parcel and the votes conflict, the City will count
the conflict as a no vote.
A majority protest would stop the proposed rate schedule adoption. If you wish to protest the proposed
rate schedule, written protests may be made in person at the hearing or delivered to:
