AGENDA TITLE: Adopt Resolution of the Lodi City Council Accepting the Lodi Fire Department's
Annual Compliance Report Regarding Hotel, Apartment, and School Inspections
As Mandated by Senate Bill No. 1205

RECOMMENDED ACTION: Adopt resolution of the Lodi City Council accepting the Lodi Fire
Department's annual compliance report regarding hotel, apartment,
and school inspections as mandated by Senate Bill No. 1205
BACKGROUND INFORMATION; Senate Bill No.1205 mandates that every city fire department shall
report annually to its administering authority on its compliance with
the Health and Safety Code, Sections 13146.2 and 13146.3. The bill
states that the report shall occur when the administering authority discusses its annual budget, or at
another time determined by the administering authority.
The California State Fire Marshal mandates that certain occupancy types be inspected annually. These
mandated occupancy types include private and public schools, hotels, motels, lodging houses and
apartment/condominium buildings. The purpose of annual fire inspections is to mitigate known hazards,
reduce risk to the community, and ensure reasonable compliance with the California Fire Code. The
Lodi Fire Department performs the mandated inspections, in addition to other inspections at local
businesses, as part of the Department's prevention program. In 2022, the Lodi Fire Department
inspected 100% of the state mandated annual inspections within the calendar year.
California Health and Safety Code Section 13146.2 mandates that the local fire department inspect all
hotels, motels and lodging houses once annually. The Lodi Fire Department inspected twenty (20) out
of twenty (20) hotels, motels and lodging houses during the 2022 calendar year.
California Health and Safety Code Section 13146.2 mandates that the local fire department inspect all
apartments once annually. The California Building Code also specifies that condominiums should be
considered apartments for building code application. An apartment shall consist of three or more
attached units, and excludes all duplex and townhome buildings as defined by code. The Lodi Fire
Department inspected four hundred and seventy-one (471) out of four hundred and seventy-one (471)
apartment/condominium complexes during the 2022 calendar year.

California Health and Safety Code Section 13146.3 mandates that the local fire department inspect all
public and private schools once annually. The Lodi Fire Department inspected thirty-nine (39) out of
thirty-nine (39) school facilities during the 2022 calendar year.
In total, the Lodi Fire Department conducted 530 state -mandated inspections during the 2022 calendar
year. Further, the acceptance of this compliance report and the recommended Resolution fulfill the
statutory requirements contained in California Health and Safety Code Section 13146.2, 13146.3 and
13146.4, as amended by SB 1205.

RESOLUTION NO. 2023-69
A RESOLUTION OF THE LODI CITY COUNCIL ACCEPTING THE LODI FIRE
DEPARTMENT'S ANNUAL COMPLIANCE REPORT REGARDING HOTEL, APARTMENT,
AND SCHOOL INSPECTIONS AS MANDATED BY SENATE BILL NO. 1205
WHEREAS, Senate Bill No.1205 mandates that every city fire department shall report
annually to its administering authority on its compliance with the Health and Safety Code,
Sections 13146.2 and 13146.3; and
WHEREAS, in 2022, the Lodi Fire Department inspected 100% of the State -mandated
annual inspections within the calendar year; and

NOW, THEREFORE, BE IT RESOLVED that the Lodi City Council does hereby accept
the Lodi Fire Department's Annual Compliance Report as mandated by Senate Bill No. 1205;
and
BE IT FURTHER RESOLVED, pursuant to Section 6.3q of the City Council Protocol
Manual (Res. No. 2019-223), the City Attorney is hereby authorized to make minor revisions to
the above -referenced document(s) that do not alter the compensation or term, and to make
clerical corrections as necessary.
