BACKGROUND INFORMATION: In December 2022, City Council approved the purchase of 120 microfiltration modules which were to be installed at the City's Surface Water Treatment Facility. The modules have since been delivered. As Noted in the December 21, 2022 Council Communication, Pall Corporation offered a $36,000 discount if the order was placed in 2022. Due to the very short notice of the savings opportunity, staff rushed to prepare the purchase order for this Council action and inadvertently left off the sales tax in the amount of $33,090. If approved, this change order ($33,090) includes the sales tax amount which needs to be retained. A late fee of $6,017 was to be assessed in late March; however, with Deputy City Manager approval, a payment was made prior to Council authorization in order to spare the expense. Staff recommends ratifying these expenses and authorizing the City Manager to Execute Change Order No. 1 to Purchase Order No. 2230171, Not -To -Exceed $33,090 for the Purchase of 120 Microfiltration Modules from Pall Corporation of Cortland, New York. FISCAL IMPACT: Funds for the filters are budgeted in the Water Plant Operations budget. This project will not impact the General Fund. NOW, THEREFORE, BE IT RESOLVED that the Lodi City Council does hereby ratify expenses and authorize the City Manager to execute Change Order No. 1 to Purchase Order No. 2230171, in an amount not to exceed $39,107, for the purchase of 120 microfiltration modules from Pall Corporation, of Cortland, New York; and BE IT FURTHER RESOLVED, pursuant to Section 6.3q of the City Council Protocol Manual (adopted 11/6/19, Resolution No. 2019-223), the City Attorney is hereby authorized to make minor revisions to the above -referenced document(s) that do not alter the compensation or term, and to make clerical corrections as necessary.
