Project — Phase 9
BACKGROUND INFORMATION: The City has reconstructed various alleys over the past 10 years. The
projects have typically included between one and two alleys per year,
depending on funding levels. Specific projects are selected based on a
citywide alley condition assessment list and are rated based on pavement condition and drainage improvement
needs.
This project reconstructed the alley north of Walnut Street, between Washington Street and Central Avenue, as
shown on Exhibit A. The project included approximately 15,000 square feet of pavement removal and
replacement, two new concrete alley approaches, installation of 550 lineal feet of concrete valley gutter,
installation of storm drain system improvements, and other incidental and related work, all
as shown on the plans and specifications for the above project.
The final cost of the contract was $440,913.54 and was completed in substantial conformance with the
specifications approved by City Council. There were two change orders totaling $41,004.54. Since the Council
action to award the contract limited City Manager change order authority to $40,000, staff is requesting Council
ratify the additional $1,004.54 expenditure that exceeded the $40,000 limit.
Change Order 1 ($21,716.79) included costs due to expended time and materials work required to address an
existing water line, which was installed more shallow than shown on the as built plans. This condition required
several final paving modifications. The original contract was 40 days; 27 calendar days were added to make
the necessary adjustments.
Change Order 2 ($19,287.75) was an internal change order in unit item quantities to account for additional
paving and gutter length to accommodate the adjusted grades. The contract was completed prior to the
adjusted contract completion date. Photos of completed work are shown in Exhibit B.

Following acceptance by the City Council, as required by law, the City Engineer will file a Notice of Completion
with the County Recorder's office. The notice serves to notify vendors and subcontractors that the project is
complete and begins their 30 -day period to file a stop notice requiring the City to withhold payments from the
prime contractor in the event of a payment dispute.
FISCAL IMPACT: The project will reduce maintenance costs in the reconstructed alleys.
FUNDING AVAILABLE: This project was funded by 2020/21 Community Development Block Grant funds
($538,147)

A RESOLUTION OF THE LODI CITY COUNCIL RATIFYING EXPENSES AND
AUTHORIZING THE CITY MANAGER TO EXECUTE CHANGE ORDERS TO
ALLEY IMPROVEMENT PROJECT — PHASE 9
WHEREAS, this project reconstructed the alley north of Walnut Street, between
Washington Street and Central Avenue, and included approximately 15,000 square feet of

WHEREAS, the final cost of the contract was $440,913.54 and was completed in

WHEREAS, there were two change orders totaling $41,004.54; and
WHEREAS, Council action to award the contract limited the City Manager's change
order authority to $40,000, and staff is requesting Council ratify the additional $1,004.54

WHEREAS, staff recommends ratifying expenses and authorizing the City Manager to
execute change orders to Alley Improvement Project — Phase 9 in the amount of $1,004.54.
NOW, THEREFORE, BE IT RESOLVED that the Lodi City Council does hereby ratify
expenses and authorize the City Manager to execute change orders to Alley Improvement
Project — Phase 9 in the amount of $1,004.54; and
BE IT FURTHER RESOLVED, pursuant to Section 6.3q of the City Council Protocol
Manual (adopted 11/6/19, Resolution No. 2019-223), the City Attorney is hereby authorized to
make minor revisions to the above -referenced document(s) that do not alter the compensation
or term, and to make clerical corrections as necessary.
