BACKGROUND INFORMATION: Governor Gavin Newsom declared a state of emergency on March, 4, 2020 as part of the state's response to address the global COVID-19 outbreak. In response to a growing demand on employee leave balances as staff became exposed to or infected with COVID-19, the City Council authorized a one-time COVID-19 special leave bank of 80 hours per employee on April 15, 2020 by adopting Resolution 2020-76. On March 11, 2021, the President signed the American Rescue Plan Act of 2021 (ARPA) that allocated $15,764,793 to Lodi of which $2,243,921 was earmarked for General Fund revenue loss. On March 2, 2022, City Council adopted Resolution 2022-63 which authorized $1,365,000 as a Priority 2 use of the General Fund ARPA revenue loss funding for the 2020 COVID-19 leave costs. To date, approximately $753,400 of 2020 COVID-19 leave has been expended. There is currently approximately $612,000 still remaining of leave balance liability in alignment with the $1,365,000 originally set aside. The State of California's declared COVID-19 State of Emergency is set to expire on February 28, 2023. As of the writing of this report, staff has not received any indication that the Governor's Office will move to continue the emergency beyond February 28th. As such, staff is recommending eliminating the 2020 COVID-19 leave liability by cashing out all remaining balances effective the first pay period following City Council action. FISCAL IMPACT: There is no fiscal impact from this item as the funding has already been set aside for this purpose. FUNDING AVAILABLE: City Council authorized the use of General Fund ARPA revenue replacement funds for the 2020 ,C//OVID-19 leave costs. GMAVAAr %lR/u�/ Andrew Keys Deputy City Manager/Internal Services Director Stephen Schwabauer, City Manager RESOLUTION NO. 2023-50 A RESOLUTION OF THE LODI CITY COUNCIL AUTHORIZING THE CASH -OUT OF EMPLOYEE COVID 2020 LEAVE BALANCES ----------------- WHEREAS, Governor Newsom declared a state of emergency on March 4, 2020 in response to the global COVID-19 outbreak; and WHERAS, the City Council provided employees with a one-time special 2020 COVID leave bank of 80 hours to address the growing demand on employee leave balances due to COVID-19 absences; and WHEREAS, the City Council authorized the use of $1,365,000 of American Rescue Plan Act of 2020 (ARPA) funds earmarked for General Fund revenue loss for the 2020 COVID leave costs; and WHEREAS, Governor Newsom declared the COVID-19 state of emergency over as of February 28, 2023. NOW, THEREFORE BE IT RESOLVED that the Lodi City Council does hereby authorize the cashing out of any remaining 2020 COVID leave balances effective the first pay period after the adoption of the resolution; and BE IT FURTHER RESOLVED that staff will bring forth the final 2020 COVID-19 special leave costs and request the authorization of budget appropriations once final figures are known.
