AGENDA TITLE: Adopt Resolution Approving Side Letter Agreement between the City and Lodi Fire Mid -
Management to Provide Additional Holiday Leave in Recognition of Juneteenth

RECOMMENDED ACTION Adopt resolution approving side letter agreement between the City and Lodi
Fire Mid -Management to provide additional Holiday Leave in recognition of
Juneteenth.
BACKGROUND INFORMATION Representatives from the City and Lodi Fire Mid -Management recently
negotiated for a successor Statement of Benefits (July 1, 2022 — June 30
2025). The successor contract did not include additional holiday leave as
was provided to other bargaining units, including the Lodi Professional
Firefighters (LPF).
It is desirable for LPF staff to promote into the Fire Mid -Management unit during their career with the City of Lodi
Fire Department. As such, it is important to maintain similar benefits between the two bargaining units so staff
do not have a reduction in their benefits. The City and Lodi Fire Mid -Management desire to increase the number
of holiday leave hours, in recognition of Juneteenth similar to the holiday leave extended to LPF, ensuring that
staff who promote into the Fire Mid -Management unit do not lose holiday leave upon their promotion.
Staff recommends that the Council approve the amendment to the Lodi Fire Mid -Management Statement of
Benefits by approving the attached side -letter agreement to provide additional holiday leave.
FISCAL IMPACT: The annual cost of the proposed agreement is $2,750 per year over the term of
the contract.
FUNDING AVAILABLE: Funding available in the Fire Department budget.

Side Letter Agreement Amending the Statement of Benefits
Between the City of Lodi and the Lodi Fire Mid -Management
July 1, 2022 — June 30, 2025
This Side Letter Agreement is entered into between the City of Lodi, a municipal corporation
("City"), and the Lodi Fire Mid -Management ("LFMM"), and is effective as of January 1, 2023.
RECITALS
WHEREAS, the Statement of Benefits between LFMM and the City has a term of July 1,
2022 — June 30, 2025 (MOU), and
WHEREAS, the City would like to provide additional holiday hours to members of the
LFMM in recognition of the Juneteenth Holiday, similar to what was extended to the Lodi
Professional Firefighters; and
WHEREAS, the City and LFMM have mutually agreed to amend Article XV — Holidays,
as follows:

15. 2 Holiday hours shall be taken in increments of not less than quarter hours and may not be
carried into the following calendar year. Each year, the pay period in which December 1
falls, employees will be paid for the unused holidays at the straight -time rate.
All other provisions of the Statement of Benefits remain in full force and effect.

RESOLUTION NO. 2023-48
A RESOLUTION OF THE LODI CITY COUNCIL
AMENDING THE STATEMENT OF BENEFITS BETWEEN THE
CITY OF LODI AND LODI FIRE MID -MANAGEMENT THROUGH
A SIDE -LETTER AGREEMENT INCREASING
HOLIDAY LEAVE IN RECOGNITION OF JUNETEENTH
WHEREAS, the Lodi City Council approved a successor Statement of Benefits (SOB)
with the Lodi Fire Mid -Management unit (LFMM) that has a term of July 1, 2022 through
June 30, 2025; and
WHEREAS, the City provides a bank of holiday leave that is comparable to the fixed
holidays provided to employees who observe the City's defined fixed holiday calendar; and
WHEREAS, the City negotiated to increase the holiday leave for other bargaining units,
including the Lodi Professional Firefighters, to include the Juneteenth holiday, beginning in
calendar year 2023; and
WHEREAS, the City and LFMM wish to enter into a side -letter agreement amending the
LFMM SOB to increase the holiday leave bank in recognition of the Juneteenth holiday; and
WHEREAS, it is recommended that Council approve the revisions to the SOB with
LFMM through a Side -Letter Agreement to increase the holiday leave bank in recognition of the
Juneteenth holiday.
NOW, THEREFORE, BE IT RESOLVED by the Lodi City Council that it does hereby
approve the attached Side -Letter Agreement (Exhibit A) between the City of Lodi and LFMM.
