Manager Schwabauer, and Public Works Director Swimley regarding operating balance trends,
installation of meters on properties with multiple units, how the utility reserve is set, and the ENR -based
increases.
Mayor Hothi opened the public hearing for public comment at 7:49 p.m.
There being no public comments, Mayor Hothi closed the public hearing at 7:52 p.m.
Mayor Pro Tempore Craig made a motion, second by Mayor Hothi, to adopt Resolution No. 2023-42
setting pre -approved Engineering News Record adjustment index for usage -based and flat water rates for
residential, commercial, and industrial customers.

H. Regular Calendar
H-1 Provide Direction to Staff on Continuance of Informal Informatlonal Meetings (aka Shirtsleeve
Meetings)_(CM).
City Manager Schwabauer provided a presentation regarding the continuance of Shirtsleeve Sessions.
Specific topics of discussion included the benefit of Shirtsleeve Sessions providing an opportunity for
longer discussions on topics than would be available at a Regular Meeting and the 7 a.m. start time of the
meeting being inconvenient to some.
Mayor Pro Tempore Craig expressed her support for continuing to have the Shirtsleeve Sessions.
Council Member Khan stated that the time is inconvenient for many people and that the time should be
adjusted to Tuesday evenings at 7 p.m.
Council Member Nakanishi expressed his support for leaving things as they are.
Mayor Hothi stated that he supports having Shirtsleeve Sessions when there are meatier topics to discuss
but to skip the meetings if there is nothing of importance to present.

Proposed Enzo's Law

Dear Hon. Mayor Hothi:
In memoriam of Enzo the husky, a beloved pet, killed by Lodi Police and Animal
Control on January 24, 2024, the Lodi City Council passes the City Ordinance
entitled "Enzo's Law".
Enzo's Law states:
No peace officer, Animal Control officer or any government independent
contractor or private citizen may use force on any housepet merely because that
housekept is running free in public spaces. The term "housepet: refers to dogs,
cats, lizards, birds.
Use of firearms and Tasers is totally forbidden except in clear life or death
situations such as a dog mauling a person or another dog or cat. Wild animals such
as Mountain Lions or foxes or feral cats are not covered by Enzo's Law.
Any use of force by any person, public employee or private citizen, upon any
housepet shall be accompanied by a duty to render assistance to the animal upon
whom force was used.
Mandatory independent autopsies by qualified Medical Examiners shall be
conducted within 12 hours of the death of any housepet and the findings
maintained permanently with photographs in the event of criminal and/or civil
litigation.
The criminal penalty for any person who violates Enzo's Law shall be mandatory 2
years felony prison time, permanent and lifetime disqualification from any
government employment in any City, County, State or the Federal Government of
the United States and payment to the lawful owners of the harmed or slain
housekept of $50,000.00 (FIFTY THOUSAND DOLLARS) to be paid first from
the pension and personal assets of the offender and then in the case of illegal acts
by any governmental employee or contractor from a City and/or County insurance
fund or asset pool. Repeat offenders of Enzo's Law duly convicted shall face
doubling of prison time and financial penalty for each repeats offense; i.e. a second
time offender shall serve 4 years in prison and shall pay $100,000.00 and a third
time offender faces 8 years in prison and shall pay $200,000.00, etc.
No expungement of any violation(s) of Enzo's Law shall be permitted.
Violations of Enzo's Law include use of firearms, Tasers, sticks, bats, clubs, stones
upon any housepet by any person, whether a government employee or private
citizen.
This law is to honor the memory of Enzo the husky, taken by unjustified violence
under color of toe law.
