SPECIAL CITY COUNCIL MEETING
CARNEGIE FORUM, 305 WEST PINE STREET

A.Call to Order / Roll Call
The Special City Council meeting of March 14, 2023, was called to order by Mayor Hothi at 7:03 a.m., at the LOEL
Senior Center, 105 South Washington Street, Lodi, CA.
Present: Council Member Bregman, Mayor Pro Tempore Craig, and Mayor Hothi
Absent: Council Member Nakanishi
Also Present: City Manager Schwabauer, City Attorney Magdich, and Assistant City Clerk Farris
NOTE: Council Member Nakanishi arrived at 7:05 a.m.
B.Regular Calendar
B-1 Provide Direction to Staff Regarding Application and Interview Questions for City Council District 4 Vacancy
and Approve Appointment Schedule for Filling City Council District 4 Vacancy (CLK)
City Manager Schwabauer provided a presentation regarding appointment to the City Council District 4 vacancy.
Specific topics of discussion included the tentative schedule, draft application, potential interview questions, and
the need for a plan to winnow the applications if a large number are received.
Council Member Nakanishi rescinded his suggestion made at the last meeting regarding not appointing an
applicant who is intending to run in the 2024 election.
Mayor Hothi verified that all Council Members were in agreement on the schedule.
Discussion ensued with Mayor Pro Tempore Craig and Mayor Hothi regarding publication of the application and
questions.
Mayor Hothi asked for public comment.
Alex Aliferis, a member of the public, stated that the process needs to be published in the newspaper and that a
core question should be added that relates to morals, ethics, values, and principles.
Discussion ensued between Mayor Hothi, Council Member Bregman, and Mayor Pro Tempore Craig regarding
requirements related to ethics. City Manager Schwabauer stated that a Council-adopted Code of Ethics is
displayed at Carnegie Forum and that the Fair Political Practices Commission, Government Code 1090, and AB
1234 govern ethics. He further stated that orientation of the new Council Member is already planned. Consensus
was reached to add a statement regarding ethics to the application.
Discussion ensued between the Council Members regarding the potential questions for applicants. Specific topics
discussed included whether or not to publish the questions, the number of questions to include, and whether
questions could address past criminal convictions. City Manager Schwabauer stated that there are laws regarding
questions related to criminal convictions and background checks, and he will research that information.
Consensus was reached to publish all potential questions and to limit the number of questions based on how many
applicants are interviewed, with all applicants being asked the same questions.
Discussion ensued between Mayor Hothi, Mayor Pro Tempore Craig, Council Member Bregman, City Manager
Schwabauer, Deputy City Manager Keys, and Fire Chief Johnson regarding public outreach. Specific topics of
discussion included mailers, social media, newspaper publication, Everbridge mass notifications, and the need for
non-electronic notification, such as postings at the Library, LOEL Senior Center, and local businesses.

There being no further business to come before the City Council, the meeting was adjourned at 7:30 a.m.
