CITY OF Aft011 ' D Z CALIFORNIA AGENDA ITEM IC406 COUNCIL COMMUNICATION AGENDA TITLE: Adopt Resolution Authorizing City Manager to Execute Change Orders to the Lodi Gun Range Ventilation Improvement Project and Appropriating Funds ($300,000) MEETING DATE: February 1, 2023 PREPARED BY: Public Works Director RECOMMENDED ACTION: Adopt resolution authorizing City Manager to execute change orders to Lodi Gun Range Ventilation Improvement Project to in and appropriating funds in the amount of $300,000. BACKGROUND INFORMATION: For over 50 years, the existing gun range, located in the basement of the City Hall Annex Building at 213 W Elm Street, has been utilized by the Lodi Police Department to practice firearm and target shooting. Recent inspection of the facility indicated performance of the existing ventilation system does not comply with current Occupational Safety and Health Administration (OSHA) standards. A project intended to upgrade the ventilation system was awarded to Diede Construction on April 2, 2022. The project includes removal of the existing HVAC system, installation of the new HVAC system with filters, modification of HVAC duct work, and other miscellaneous and related items as shown on the plans and specifications for the project. Before project demolition started, the contractor performed initial lead testing of the work area and found it higher than expected in this type of facility. Further investigation and testing found that the entire basement area including the ventilation system has extremely high lead levels on all surfaces that need to be abated before any work can begin. The indoor gun range has been in operation for more than 50 years and the lack of regular testing and cleaning resulted in the high concentrated lead level being undetected. The good news is a separate air sample indicated the lead is not present in the air. Diede prepared a proposal for the lead abatement for the area the work involved. In addition to the residual lead contamination, asbestos material must also be removed. The total cost of the abatement is estimated to be $229,905. Due to the age of the building and its history of use, there is a chance that other areas will be identified during the abatement process that need additional work. Staff is recommending authorizing the City Manager to execute change orders not -to -exceed $300,000 for this abatement. If approved, the total project cost including this change order ($229,905) and two previous change orders ($8,270) will be $635,875. The additional appropriation is requested to facilitate the necessary lead abatement along with any additional unforeseen changes in the work. This abatement is necessary to move this project forward and also will be needed if other areas in the basement area are to be repurposed by the City. Staff recommends authorizing City Manager to execute the change orders for the abatement to Lodi Gun Range Ventilation Improvement Project and appropriating funds in the amount of $300,000. Additional lead dust wipe sample collections were performed on November 14, 2022. This additional lead dust wipe sampling report outlines our services provided prior to the start of the proposed remediation of lead dust. INSPECTION OBSERVATIONS OES, Inc, visually inspected various areas outside of the proposed remediation areas followed by the collection of lead dust wipe samples. Basement; Mechanical Room on HVAC Duct Work 144 inx 575,000 µg/tlz CONCLUSION The results of the lead dust wipe samples collected from outside of the proposed remediation areas show lead dust levels that are also extremely elevated when compared to Title 17 California Code of Regulations 35035 clearance levels, Title 17 35035 clearance levels for lead containing dust are less than 10 micrograms per square toot for interior floors and less than 100 micrograms per square foot for interior horizontal surfaces. Based on visual observations and analytical results of the lead dust wipe samples collected from outside of the proposed remediation areas, these areas are also considered to be extremely contaminated In regards to lead Aust. !IECOMMENDATION OES recomi�nends additional wipe sampling be conducted within both the East and West Stairwells, as well as on the first floor stairwell landing areas to determine if cross contamination is present from the basement. LIMITATIONS All findings contained within this inspection report have been promulgated in accordance with general industry standards and practices at the time of its preparation, as applied by industry professionals. Other conditions may exist which could not be identified within the current scope of this inspection or which were not accessible during our site inspection. Additional Information The Lodi Police Foundation, a California non-profit corporation, has over the past several years donated funding for several equipment purchases for use by the Lodi Police Department. These donations are integral to the Lodi Police Department's needs that are not met through the general fund. The Lodi Police Foundation is donating $200,000 to the City to offset HVAC and Exhaust system equipment, construction materials, and labor for the City Hall Annex indoor gun range for use by the Lodi Police Department. NOW, THEREFORE, BE IT RESOLVED that the Lodi City Council does hereby authorize the City Manager to execute change orders to the Lodi Gun Range Ventilation Improvement Project, in an amount not to exceed $300,000; and BE IT FURTHER RESOLVED that the Lodi City Council does hereby appropriate funds in the amount of $300,000 to General Fund Capital (43199000.77020); and BE IT FURTHER RESOLVED, pursuant to Section 6.3q of the City Council Protocol Manual (adopted 11/6/19, Resolution No. 2019-223), the City Attorney is hereby authorized to make minor revisions to the above -referenced document(s) that do not alter the compensation or term, and to make clerical corrections as necessary.
