SPECIAL CITY COUNCIL MEETING
CARNEGIE FORUM, 305 WEST PINE STREET
TUESDAY, FEBRUARY 28, 2023
A.Call to Order / Roll Call
The Special City Council meeting of February 28, 2023, was called to order by Mayor Hothi at 2:00 p.m.
Present: Council Member Bregman, Council Member Nakanishi, Mayor Pro Tempore Craig, and Mayor
Hothi
Absent: None
Also Present: City Manager Schwabauer, City Attorney Magdich, and City Clerk Nashed
B.Announcement of Closed Session
a)Threatened and Anticipated Litigation: Government Code §54956.9(b) (One Case) and Initiation of
Litigation: Government Code §54956.9(d)(4) (One Case). Conference with Legal Counsel Regarding
Potential Lawsuit and Claims by Shakir Khan against the City of Lodi Based on His Resignation as a
City of Lodi Council Member (see attached email from attorney N. Allen Sawyer, pursuant to Fowler v.
City of Lafayette) (CA)
C.Adjourn to Closed Session
At 2:02 p.m., Mayor Hothi adjourned the meeting to a Closed Session to discuss the above matters. The
Closed Session adjourned at 3:40 p.m.
D.Return to Open Session / Disclosure of Action
At 3:42 p.m., Mayor Hothi reconvened the City Council meeting, and City Attorney Magdich disclosed the
following actions.
In regard to Item B-a), discussion and direction was given by the Council by unanimous vote to set a Special
Meeting for March 7, 2023, at 7:00 a.m. to present options for filling the vacancy in District 4, based on the
resignation of Shakir Khan, which was effective on February 16, 2023. For Initiation of Litigation under
Government Code §54956.9(d)(4), there was no reportable action.
E.Adjournment
There being no further business to come before the City Council, the meeting was adjourned at 3:42 p.m.
