REGULAR CITY COUNCIL MEETING

A.Call to Order / Roll Call
The Regular City Council meeting of February 1, 2023, was called to order by Mayor Hothi at 7:00 p.m.
Present: Council Member Bregman, Council Member Khan, Council Member Nakanishi, and Mayor Hothi
Absent: Mayor Pro Tempore Craig
Also Present: City Manager Schwabauer, City Attorney Magdich, and City Clerk Nashed
Council Member Bregman attended the meeting via teleconference. City Clerk Nashed announced that all votes will
be roll call votes.
B.Presentations
B-1 Family, Career and Community Leaders of America Proclamation (CLK)
Mayor Hothi presented a proclamation to Toni Dahlen and students from Lodi Unified School District proclaiming
February 13 through 17, 2023, as Family, Career and Community Leaders of America Week in the City of Lodi.
C.Consent Calendar (Reading; Comments by the Public; Council Action) All matters listed on the consent
calendar are considered to be routine and will be acted upon by one motion. There will be no separate
discussion of these items. If a member of the public would like a consent calendar item pulled and
discussed separately, refer to the Notice at the beginning of this agenda.
Council Member Nakanishi made a motion, second by Council Member Khan, to approve the following items
hereinafter set forth, except those otherwise noted, in accordance with the report and recommendation of the City
Manager.

C-2 Approve Minutes (CLK)
The minutes of December 21, 2022 (Regular Meeting) and January 4, 2023 (Regular Meeting) were approved as
written.
C-3 Adopt Resolution Awarding Contract for Hale Park Parking Lot Reconstruction to Tosted Asphalt, Inc., of
Fresno ($81,520) and Authorizing City Manager to Execute Change Orders ($30,000) (PW)
This item was pulled from the agenda by staff.
C-4 Adopt Resolution Awarding Contract for Blakely Park - Enze Pool Shallow End Adjustment to Western Water
Features, Inc., of El Dorado Hills ($197,175), and Authorizing City Manager to Execute Change Orders
($20,000) (PW)
The item was pulled by Council Member Khan.
City Manager Schwabauer provided a brief report on the item.
Council Member Khan made a motion, second by Council Member Nakanishi, to adopt Resolution No. 2023-21
awarding the contract for Blakely Park - Enze Pool Shallow End Adjustment to Western Water Features, Inc., of El
Dorado Hills, in the amount of $197,175, and authorizing the City Manager to execute change orders in an amount
not to exceed $20,000.

($421,578) and Appropriating Funds ($422,000) (EU)
Adopted Resolution No. 2023-22 authorizing the City Manager to execute Change Order No. 1 with Schweitzer
Engineering Laboratories Engineering Services, Inc., for the Substation Relay Modernization Capital Improvement
Project, in the amount of $421,578; and appropriating funds in the amount of $422,000.
C-6 Adopt Resolution Authorizing City Manager to Execute Change Orders to Lodi Gun Range Ventilation
Improvement Project and Appropriating Funds ($300,000) (PW)
Adopted Resolution No. 2023-23 authorizing the City Manager to execute change orders to the Lodi Gun Range
Ventilation Improvement Project and appropriating funds in the amount of $300,000.
C-7 Adopt Resolution Authorizing City Manager to Execute Three-Year Professional Services Agreement for
Recreational Vehicle Abatement Services with All Towing, of Lodi ($66,300) (PD)
Adopted Resolution No. 2023-24 authorizing the City Manager to execute a three-year Professional Services
Agreement for recreational vehicle abatement services with All Towing, of Lodi, in the amount of $66,300.
C-8 Adopt Resolution Authorizing City Manager to Execute Tow Service Contract for Police Rotational Towing
Services with All Towing, of Lodi (PD)
Adopted Resolution No. 2023-25 authorizing the City Manager to execute a tow service contract for Police
rotational towing services with All Towing, of Lodi.
C-9 Adopt Resolution Amending Traffic Resolution No. 97-148 by Approving Speed Limit Modifications on
Stockton Street from Rocky Lane to Lebaron Boulevard, 35 to 25 MPH; and Lebaron Boulevard from
Reynolds Ranch Parkway to Stockton Street, 30 to 25 MPH (PW)
This item was pulled by Council Member Nakanishi.
Council Member Nakanishi stated that the determination to decrease the speed limit is a process that involves an
engineering traffic survey and must abide by the government vehicle code.
Council Member Khan made a motion, second by Council Member Nakanishi, to adopt Resolution No. 2023-26
amending Traffic Resolution No. 97-148 by approving speed limit modifications on Stockton Street from Rocky Lane
to Lebaron Boulevard, 35 to 25 MPH; and Lebaron Boulevard from Reynolds Ranch Parkway to Stockton Street, 30
to 25 MPH.

Adopted Resolution No. 2023-27 granting signature authority to certain City staff for investment of monies in the
Local Agency Investment Fund.
C-11 Adopt Resolution Updating City Staff Signers on City of Lodi Farmers & Merchants Bank Accounts (ISD)
Adopted Resolution No. 2023-28 updating City staff signers on City of Lodi Farmers & Merchants Bank accounts.
H.Regular Calendar
Mayor Hothi announced that due to the high number of individuals that wish to submit a public comment on non-
agenda items, that portion of the meeting will be moved to the end of the meeting.
H-1 Receive for File the Following Reports and Financial Statements Submitted by The Pun Group, LLP and
Finance Department for Fiscal Year 2021-2022, Including the GANN Limit and Single Audit Report (ISD)
Vanessa Burke provided a PowerPoint presentation regarding the GANN limit and Single Audit Report for the Fiscal
Year ended June 30, 2022. Specific topics of discussion included Scope of Work - Financial Statement Audit,
Compliance Audit, and agreed upon procedures; and audit results - GANN limit, Single Audit, and historical audit
results.
Council Member Khan made a motion, second by Council Member Nakanishi, to receive for file the following
reports and financial statements submitted by The Pun Group, LLP and Finance Department for Fiscal Year 2021-
2022, including the GANN Limit and Single Audit Report.

E.Comments by the City Council Members on Non-Agenda Items
Council Member Nakanishi stated that residents have expressed concerns regarding high speeds at the
roundabout and crosswalk at Lodi Avenue and Rose Gate Drive, near Rose Gate Park.
Mayor Hothi conveyed his condolences to the family of the dog, Enzo, thanked the Chief of Police for conducting an
internal investigation and requesting an independent review by the District Attorney's Office into the incident, and
asked the public to give the officers and their families space.
Council Member Khan conveyed his condolences to the family of the dog, Enzo, noted a recent shooting incident in
Tracy, thanked the Police Chief for conducting an internal investigation, and thanked the Police Department for
protecting the City every day.
Council Member Bregman conveyed his condolences to the family for the dog, Enzo, thanked the Police
Department for conducting an investigation into the incident, and shared a letter from resident, Gary Brand,
regarding the City office closures every other Friday.
F.Comments by the City Manager on Non-Agenda Items
City Manager Schwabauer provided a brief explanation regarding the history of why the City started the office
closures every other Friday.
Chief of Police Sierra Brucia provided a statement regarding the incident between a police officer and a dog named
Enzo, during which the dog died.

Mayor Hothi announced that due to the high volume of participants wishing to submit a public comment on a non-
