AGENDA TITLE: Set Public Hearing for November 16, 2022 to Consider Adoption of the 2022 California
Building Code, California Existing Building Code, Mechanical Code, Electrical Code,
Plumbing Code, Residential Code, Green Building Standard Code and Fire Code

RECOMMENDED ACTION: Set Public Hearing for November 16, 2022 to Consider Adoption of the

Mechanical Code, Electrical Code, Plumbing Code, Residential Code,
Green Building Standard Code and Fire Code.
BACKGROUND INFORMATION: Pursuant to Health and Safety Code Section 18938, the California
Building Standards Commission has selected January 1, 2023, as the
effective date for the 2022 California Building Code, 2022 California
Existing Building Code, 2022 California Mechanical Code, 2022 California Electrical Code, 2022 California
Plumbing Code, 2022 California Residential Code, 2022 California Fire Code, and 2022 California Green
Building Standard Code.
Every three years, Building/Construction and Fire Codes are amended by the State to include provisions of the
most recent version. The State of California Building Standards Commission adopts new State standards, which
cities and counties are therefore mandated to adopt. If codes with amendments are not adopted locally by
January 1, 2023, then cities are required to follow State codes only. The need for the new ordinances is to adopt
specific Appendixes and/or Administration provisions not adopted by the State. An example of this is:
Administration Chapter I, Division II has been amended to have the City Council sit as the board
of appeals for alternate materials and types of construction versus a separate appointed board
of appeals; and
Appendix J will be adopted to assist staff and design professionals with clear direction for
construction design guidelines for grading, excavation and earthwork.
The major changes in this code cycle are in the California Building Code, California Energy Code, and California
Green Building Standard Code. These changes will have some benefits and restrictions compared to the existing
Codes. Some of the changes in the building codes are as follows:
California Residential Code Changes:
R327 Aging -in-place design and fall prevention Added to address specific aging -in-place design
elements in new residential construction to facilitate access to operational features and to allow people
to stay longer in their homes as they age.

California Building Code Changes:
105.5.1 [Permit] Expiration. New section changed permit expiration from 180 days to 12 months.
Includes a provision stipulating that every permit shall remain valid if the work on the site authorized by
the permit is commenced within 12 months after its issuance. This amendment also allows for permit
extensions; the exception being when the work authorized by the permit is determined to have been
abandoned.
California Fire Code Changes:
105.6.53 Lithium batteries
Amendment to require an operational permit for an accumulation of more than 15 cubic feet of lithium -
ion and lithium metal batteries and storage shall comply with new amendments in CFC Section 322.
The code is attempting to keep pace with the ever-changing battery technology and the Energy
Storage Systems (ESS). This is evident in the number of changes to Chapter 12 — Energy Systems.
Chapter 12 — Energy Systems:
Section 1207.11.7 through 1207.7.3
Amendments regarding specific appliances, ESS equipment and devices that need protection from
impact in a clearly defined area in residential garages and carports.

Added to illustrate the zones in which a typical residential garage ESS installation would trigger the
need for impact protection, following prescriptive barrier and post designs.
We have tried to notify all affected parties by, publication in the Lodi News -Sentinel, E-mail notification as well
as notices provided at the front counter, and Community Development newsletter. Informational handouts are
currently being revised to reflect the new code requirements. These handouts will be available at the Building &
Safety kiosk and on the City web page on or before January 1, 2023.
Staff's recommendation is to approve the 2022 codes as amended. The Ordinances have been presented in
highlight format to more easily identify the changes to aid in review.
