RECOMMENDED ACTION: Adopt resolution rejecting all bids, approve revised specifications,
authorize re -advertisement for bids, authorize City Manager to award
Contract to lowest, responsive bidder for Peterson Park Tennis Court
Resurfacing, in an amount not -to -exceed $60,000, and authorize City Manager to execute change orders in
an amount not -to -exceed $5,000.
BACKGROUND INFORMATION: Council approved the Peterson Park Tennis Court Resurfacing
specifications and authorized advertisement for bids on September 21,
2022. This contract was originally intended to fill minor joints and cracks,
repair low spots and apply a textured, color surfacing system consisting of new acrylic coatings and new
textured game lines.
The City received the following three bids on October 13, 2022:
The bid package from Vintage Contractors, Inc. was a responsive bid received prior to the bid opening.
However, the bid package was inadvertently misplaced and then opened after the public bid opening. As the
City Clerk was not present, nor was the bid opened in a public setting, staff recommends rejecting all bids and
re -advertising to fully ensure compliance to Public Contract Code.
The scope of the project has been revised to include a crack repair system to address the more significant
cracks in the court surface. The system is estimated to cost an additional $12,000. Cracks will be filled and
taped with a two -layer taping system which will significantly prolong court life. The revised specifications
which include the crack repair system, are on file in the Public Works Department. The planned re -bid
opening date is November 29, 2022. The estimate remains at $53,000.

A RESOLUTION OF THE LODI CITY COUNCIL REJECTING ALL BIDS;
APPROVING REVISED SPECIFICATIONS; AUTHORIZING
RE -ADVERTISEMENT FOR BIDS; AUTHORIZING THE CITY MANAGER TO
AWARD A CONTRACT TO THE LOWEST RESPONSIVE BIDDER FOR
PETERSON PARK TENNIS COURT RESURFACING; AND AUTHORIZING
THE CITY MANAGER TO EXECUTE CHANGE ORDERS
WHEREAS, Council approved the Peterson Park Tennis Court Resurfacing
specifications and authorized advertisement for bids on September 21, 2022; and

all bids for Peterson Park Tennis Court Resurfacing; and
BE IT FURTHER RESOLVED that the Lodi City Council does hereby approve the
revised specifications and authorize re -advertisement for bids; and
BE IT FURTHER RESOLVED that the Lodi City Council does hereby authorize the
City Manager to award a contract to the lowest responsive bidder for Peterson Park Tennis
Court Resurfacing in an amount not to exceed $60,000; and
BE IT FURTHER RESOLVED that the Lodi City Council does hereby authorize the
City Manager to execute the contract and change orders in an amount not to exceed $5,000;
and
BE IT FURTHER RESOLVED, pursuant to Section 6.3q of the City Council Protocol
Manual (adopted 1116/19, Resolution No. 2019-223), the City Attorney is hereby authorized to
make minor revisions to the above -referenced document(s) that da not alter the compensation
or term, and to make clerical corrections as necessary.
