BACKGROUND INFORMATION: The San Joaquin County Sheriff's Department (Sheriff) Community Corps Services provides an inmate program for work release. Community Corps participants are low-risk inmates scheduled through the Sheriff's central office. When a project is scheduled, participants are transported from the County facility directly to the work site. An Inmate Work Site Supervisor drives the bus to and from the County facility and provides work site supervision. The City does not provide transportation nor supervision of the Community Corps work program participants. Program rates include a Community Corps crew, supervisor, transportation to and from the work site, vehicles, tools, equipment and a garbage truck if necessary. San Joaquin County Sheriff's Office shall provide liability insurance certificate(s) for Community Corps Services. Parks, Recreation and Cultural Services desires to use Community Corps crews on an as -needed basis to help with weeding, fire hazards, clearing and grubbing at various parks including Grape Bowl, DeBenedetti and Lodi Lake Nature Area. Community Corps Services have been used in the past by PRCS and Public Works and services provided have proven to be efficient and highly cost effective. Anticipated annual projects include: Nature Area — Creek Clearing & Trail Pruning (1 time per year) - $3,540 3 days / Crew and Equipment @ 620 per day 3 days / Garbage Truck @ 560 per day Grape Bowl — Side Hill Weed Growth Removal (1 time per year) - $3,540; $7,080 (for 2 times per year) 3 days / Crew and Equipment @ 620 per day 3 days / Garbage Truck @ 560 per day Vat Stephen Schwabauer, City Manager Adopt Resolution Authorizing the City Manager to Execute a Contract with San Joaquin County Sheriff's Office Community Corps Services for General Labor within Parks and Recreation Facilities (up to $75,000 for three years) October 19, 2022 Page 2 DeBenedetti Park — Fire Break (1 time per year) - $2,360 2 days / Crew and Equipment @ 620 per day 2 days / Garbage Truck @ 560 per day FISCAL IMPACT: The use of the Community Corps crews will result in an overall cost savings ($18,000 - $20,000 annually), i.e. staff time, equipment and disposal of weeds, brush and tree trimmings. This Agreement is made and entered into on , by and between the San Joaquin County Sheriff's Department Community Corps (hereinafter known as SHERIFF) and City of Lodi Parks, Recreation and Cultural Services (hereinafter known as CUSTOMER). Whereas, the SHERIFF provides general labor by inmates and also provides for their supervision in performing various tasks in and about the CUSTOMER property; and Whereas, the CUSTOMER can provide work opportunities for inmates and is desirous of obtaining the benefits of such labor and supervision; Now, therefore, it is agreed as follows: 1. The initial term of this Agreement shall begin on the date indicated above and be in effect for twelve (12) months from that date. The initial term shall be renewed automatically for two more successive twelve (12) month period(s), unless either party gives written notice to terminate the agreement, which notice may be given at the will of either party with or without cause. Either party may terminate this Agreement after giving thirty (30) days written notice to the appropriate designee as identified in Section 10 of this contract. The total term of this contract shall not exceed thirty-six (36) months. 2. The SHERIFF shall provide inmate laborers under the SHERIFF's supervision to perform the work as outlined in "Attachment A, Job Duties to be Performed by Inmate Labor Work Crews" in and about the grounds of the CUSTOMER. The SHERIFF shall be responsible for all aspects of transportation, safety and supervision of inmates when so engaged. 3. The CUSTOMER shall pay the SHERIFF the appropriate sum as adopted and established by the Board of Supervisors, in the Community Corps Program (CCP) fee schedule. The current fee schedule is attached and incorporated with this agreement. Services performed under this Agreement shall not exceed $25,000 per year. 4. The CUSTOMER shall pay all associated disposal fees for work performed under this Agreement. 5. Each party agrees that it shall hold the other free and harmless from any and all liability for damage or claims for damage for personal injury or property damage occasioned by their respective performance of this Agreement, save and except for the sole negligence of each. 6. The CUSTOMER retains the right to direct job locations so long as the SHERIFF deems it safe for both the public and the inmates. All work sites must be located in the geographic limits of San Joaquin County. Sheriff Department Community Corps Service Agreement with CUSTOMER Page 2 of 2 7. The SHERIFF agrees that all inmate workers and supervisors are and will remain members of the SHERIFF's workforce and will be covered under the SHERIFF's insurance programs, including worker's compensation coverage. 8. The SHERIFF will bill the CUSTOMER on a monthly basis in accordance to work performed under this Agreement. This document and referenced attachments constitute the entire Agreement between the parties and may be amended by written consent by both parties. 10. The designee for the San Joaquin County Sheriff's Office shall be the current Honor Farm Lieutenant via the address below the signature line below. Billing inquiries should be directed to San Joaquin County Sheriffs Office Management Services — Rochelle Garcia (209) 468-5127 or rr-orcia(@,siLrov.org RESOLUTION NO. 2022-249 A RESOLUTION OF THE LODI CITY COUNCIL AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT WITH SAN JOAQUIN COUNTY SHERIFF'S OFFICE COMMUNITY CORPS SERVICES FOR GENERAL LABOR WITHIN PARKS AND RECREATION FACILITIES WHEREAS, the San Joaquin County Sheriff's Office Community Corps Services provides an inmate program for work release whereby low-risk participants provide general labor services; and WHEREAS, an Inmate Work Site Supervisor, crew, transportation to and from the work site, vehicles, tools, equipment, and a garbage truck, if necessary, can be provided at a reasonable cost; and WHEREAS, San Joaquin County Sheriff's Office shall provide liability insurance certificate(s) for Community Corps Services; and WHEREAS, Parks, Recreation and Cultural Services desires to utilize the Community Corps Services on an as -needed basis to help with weeding, fire hazards, clearing, and grubbing at various parks, including Grape Bowl, DeBenedetti Park, and Lodi Lake Nature Area. NOW, THEREFORE, BE IT RESOLVED that the Lodi City Council does hereby authorize the City Manager to execute a three-year contract with San Joaquin County Sheriff's Office Community Corps Services, in an amount not to exceed $75,000; and BE IT FURTHER RESOLVED pursuant to Section 6.3q of the City Council Protocol Manual (Res. No. 2019-223), the City Attorney is hereby authorized to make minor revisions to the above -referenced document(s) that do not alter the compensation or term, and to make clerical corrections as necessary.
