The Closed Session adjourned at 7:00p.m. At 7:00 p.m., Mayor Chandler reconvened the City Council meeting, and City Attorney Magdich disclosed the following actions. Item C-2a) was discussion only, with further reportable action. Item C-2b) was discussion and direction, with no further reportable action. Mayor Chandler presented a proclamation to Elizabeth Sanchez, Community Engagement and Education Program Manager with the Women's Center-Youth & Family Services, proclaiming October 2022 as Domestic Violence Awareness Month in the City of Lodi. Mayor Chandler presented a proclamation to Lodi Fire Chief Ken Johnson proclaiming October 9 through 15, 2022 as Fire Prevention Week in the City of Lodi. Mayor Chandler presented a proclamation to Lodi Electric Utility Department Senior Administrative Clerk Justine Delgado proclaiming October 16 through 22, 2022, as Public Power Week in the City of Lodi. Mayor Pro Tempore Hothi made a motion, second by Council Member Nakanishi, to approve the following items hereinafter set forth, except those otherwise noted, in accordance with the report and recommendation of the City Manager. Adopted Resolution No. 2022-229 authorizing the City Manager to execute an Improvement Agreement for 620 South Central Avenue Public Improvements. Adopted Resolution No. 2022-230 authorizing the City Manager to execute a five-year Professional Services Agreement with Vertical Communications, Inc., of Phoenix, Arizona, to manage and support phone services from 8x8, Inc., of San Jose, in an amount not to exceed $855,000, and appropriating funds in the amount of $171,000. Adopted Resolution No. 2022-231 authorizing the City Manager to execute Amendment No. 2 to the Construction Services Agreement with Ranse Gale Construction for additional services related to the development of the Harmony Homes Project, in an amount not to exceed $15,000. This item was pulled by Council Member Nakanishi. Discussion ensued between Council Member Nakanishi, Chief of Police Sierra Brucia, and City Manager Schwabauer regarding the application submitted for the grant annually, how the grant money is utilized, and resident concerns regarding speed limits in certain areas. Mayor Pro Tempore Hothi made a motion, second by Council Member Nakanishi, to adopt Resolution No. 2022-237 authorizing the Lodi Police Department to participate in the Selective Traffic Enforcement Program Grant funded by the Office of Traffic Safety; authorizing the City Manager to execute grant documents on behalf of the City of Lodi; and appropriate funds in the amount of $150,000. Business Development Manager Astrida Trupovnieks provided a report regarding utilization rates of the existing electric vehicle chargers programs and the status of the implementation of the customer rebates program. Mayor Pro Tempore Hothi made a motion, second by Council Member Nakanishi, to adopt Resolution No. 2022-238 amending Lodi Electric Utility Electric Vehicle Strategy by revising and Organizational Gap Analysis and Preferred Work Methods Development Services ($75,000) (EU) C-11 Adopt Resolution Authorizing City Manager to Execute Confirmation No. 0269 Under Northern California Power Agency Support Services Program Agreement for After Hours Answering and Dispatch Services for Electric Utility and Public Works Departments for a Period of Three Years ($281,460) (EU/PW) C-12 Adopt Resolution Authorizing Lodi Police Department to Participate in Selective Traffic Enforcement Program Grant Funded by Office of Traffic Safety; Authorizing City Manager to Execute Grant Documents on Behalf of the City of Lodi; and Appropriate Funds ($150,000) (PD) C-13 Adopt Resolution Amending Lodi Electric Utility Electric Vehicle Strategy by Revising and Adding Customer Rebates and Incentives (EU) 4 adding customer rebates and incentives. Adopted Resolution No. 2022-241 approving Year 2022 amendments to Conflict of Interest Code Government Code Section 87306.5. Rescinded Resolution No. 2022-58 and adopted Resolution No. 2022-242 authorizing the issuance of procurement cards to specified positions. Bertsch to the Greater Lodi Area Youth Commission; and Post for One Vacancy for a Greater Lodi Area Youth Commission Adult Advisor (CLK) 5 POSTING: Greater Lodi Area Youth Commission -Adult Advisor Jennifer Phillips-Lorentzen - Term to expire May 31, 2023 Set a public hearing for October 19, 2022 to consider an ordinance amending Lodi Municipal Code Title 17 – Development Code – to implement Senate Bill 9 pertaining to “Urban Lot Splits” and “Two Unit Urban Residential Development” in Residential Low-Density Zoning District. Manny Chin provided public comment thanking the Police Department for keeping Lodi safe and suggested the Police Department budget be increased during the next budget cycle. Council Member Nakanishi stated that he is in support of adding police officer positions due to growth and traffic concerns. Mayor Chandler invited Chief of Police Brucia to speak on the current staff conditions at the Lodi Police Department. Chief of Police Brucia thanked Manny Chin for his comment and provided a report regarding staffing and duties of various positions. City Manager Schwabauer noted that since 2018, there have been eight sworn positions added to the Police Department. Council Member Khan thanked the Code Enforcement Division, Public Works Department, and Community Development Department for cleaning up a property with violations. Council Member Khan also asked for the status of two agenda items, street sweeping and proactive code enforcement, approved at the August 3, 2022 City Council meeting. Public Works Director Charlie Swimley provided an update stating that a street sweeping plan with be presented to Council in November. City Manager Schwabauer provided an update stating that the Code Enforcement Division is fully staffed and is currently proactively patrolling for violations of the Lodi Municipal Code. Council Member Khan stated that there has been a notable difference and thanked staff. Council Member Kuehne stated he was looking forward to the Goal Setting update, announced the ground breaking event of the State Route 99/Turner Road project will be held on October 26 at 9:00 a.m., announced that State Route 99 will be expanded from two lanes to three lanes, and provided an update regarding artwork at State Route 99/Turner Road and artwork at Interstate 5 near Flag City. C-19 Set Public Hearing for October 19, 2022 to Consider Ordinance Amending Lodi Municipal Code Title 17 –Development Code –to Implement Senate Bill 9 Pertaining to “Urban Lot Splits” and “Two Unit Urban Residential Development” in Residential Low-Density Zoning District (CD) D. Comments by the City Manager on Non-Agenda Items G.Public Hearings –None 6 Public Works Director Swimley provided a report regarding the early recruitment of a Management Analyst position for Public Works solid waste support. Specific topics of discussion included duties of current Management Analyst position, impact of requirements of Senate Bill 1383, timeline of recruitment and funding sources. Council Member Nakanishi stated the City hires additional employees to fulfill the mandates of Senate Bill 1383. Council Member Nakanishi made a motion, second by Council Member Khan, to authorize the early recruitment of a Management Analyst position for Public Works solid waste support. City Manager Schwabauer provided a brief report on the donation from Hutchins Street Square Foundation to be accepted by Council through a vote. Council Member Kuehne made a motion, second by Council Member Nakanishi, to adopt Resolution No. 2022-243 accepting the Hutchins Street Square Foundation donation of a light board for the Charlene Powers Lange Performing Arts Theatre and two pool heaters for the Hutchins Street Square indoor pool. Specific topics of discussion included H. Regular Calendar H-1 Authorize Early Recruitment of Management Analyst Position for Public Works Solid Waste Support (PW) H-2 Adopt Resolution Accepting Hutchins Street Square Foundation Donation of Light Board for Charlene Powers Lange Performing Arts Theatre and Two Pool Heaters for Hutchins Street Square Indoor Pool and Present Hutchins Street Square Foundation with Proclamation for Their Continuous Financial Report Through Their Generous Financial and Materials Donations in 2021 and 2022 ($80,592.55) (PRCS) H-3 Adopt Resolution Authorizing City Manager to Enter into All Agreements Necessary to Locate, Develop, Construct, and Operate a 20-48 MW State of California Funded Natural Gas Power Plant in the City of Lodi (CM) 7 recent power outage due to a failure in relay of a PG&E transmitter, a State-funded program to construct generation for emergency power, timeline of project, CEQA requirements, requirements of location of power plant, possible sites, State funding of project, reviewed all authorities requested to be granted to City Manager by City Council to proceed with the project, and benefits of project to the State and to the City of Lodi. Council discussion ensued with City Manager Schwabauer and Electric Utility Director Jeff Berkheimer regarding the duties of California ISO, the qualifications of Enchanted Rock, possible costs incurred by the City of Lodi and the State of California, and the distinction that this project is a peaker plant. Enchanted Rock representative Allan Schurr stated that Enchanted Rock is excited to work with the City of Lodi on this project. Mayor Chandler made a motion, second by Council Member Nakanishi, to adopt Resolution No. 2022-244 authorizing the City Manager to enter into all agreements necessary to locate, develop, construct, and operate a 20-48 MW State of California funded natural gas power plant in the City of Lodi.
