RECOMMENDED ACTION: Set a public hearing for October 19, 2022, to consider an Ordinance
Amending the Lodi Municipal Code to amend Lodi Municipal Code Title 17—
Development Code to Implement Senate Bill 9, Pertaining to Urban Lot
Splits and Two Unit Urban Residential Development in the Residential Low -Density (RLD) Zoning District.
BACKGROUND INFORMATION: Senate Bill 9 (Chapter 162, Statutes of 2021), the "California Home Act,"
was approved by the state legislature and signed into law by Governor
Gavin Newsom in 2021 as part of the state's broader effort to increase the
development of affordable housing. SB -9 seeks to increase the supply of housing by requiring that cities and
counties implement ministerial procedures to approve the subdivision of existing residential lots and the
development of more than one dwelling unit on parcels zoned for single-family homes.
SB -9 took effect on January 1, 2022, and currently regulates both Urban Lot Splits and Two -Unit Urban
Development in Lodi. However, SB -9 allows local agencies to adopt specific regulations implementing the law.
The proposed amendments to the Lodi Zoning Code would replace state law. Staff from the City Attorney's office
and the Community Development Department, working with outside legal counsel, have developed proposed
new regulations to be added to the Lodi Zoning Code to implement SB -9. Two new sections would be added to
the Zoning Code:
• Section 17.36.150 "Two Unit Urban Residential Development"; and
• Section 17.55 "Urban Lot Split"
In addition, several new terms used in the new regulations would be added to the Zoning Code Glossary.
