AGENDA TITLE: Public Hearing to Consider a Resolution to Vacate the 6 -foot Public Utiltiy Easement
Along the North Property Line of Lot 189, Lakewood Subdivision, Unit No. 4

RECOMMENDED ACTION: That the City Council, after reviewing the findings of the
Planning Commission, conduct a public hearing to consider a resolution to
vacate the 6 -foot public utility easement along the north property line of
Lot 189, Lakewood Subdivision, Unit No. 4, as shown on Exhibit A.
BACKGROUND INFORMATION: At the regular Council meeting of January 17, 2001, the City Council
adopted a resolution of intention to vacate the 6 -foot public utility
easement along the north property line of Lot 189 of
Lakewood Subdivision, Unit No. 4, saving and excepting the west
6 feet and the east 5 feet of the public utility easement, and referred the matter to the
Planning Commission. The Planning Commission held a public hearing on January 24, 2001, to
determine public need, present or future, for this public utility easement. Resolution No. P.C. 01-04 was
passed and adopted recommending that the 6 -foot public utility easement along the north line of Lot 189
be vacated.
The public utility easement was orginally intended for utility poles and overhead utility lines. A new
public utility easement has been dedicated for this purpose on a 30 -foot strip of land north of the original
easement. The owners of Lot 189 purchased this property from the City in 1998. Abandonment of the
6 -foot easement along the north line of Lot 189 will allow the owners to make improvements and better
utilize their rear yard.

A RESOLUTION OF THE LODI CITY COUNCIL
DECLARING ITS INTENTION TO VACATE THE 6 -FOOT
PUBLIC UTILITY EASEMENT ALONG THE NORTH LINE
OF LOT 189, LAKEWOOD SUBDIVISION, UNIT NO. 4
BE IT RESOLVED by the City Council of the City of Lodi as follows:
It is the intention of the City Council of the City of Lodi, acting in accordance with the
provisions of Section 8300 et seq. of the Streets and Highways Code of the State of
California, to vacate and abandon the public utility easement along the North line of Lot 189,
Lakewood Subdivision, Unit No. 4, as shown on Exhibit A attached hereto and thereby made
a part hereof.
Reference is hereby made to a map or plan on file in the office of the City Clerk of the
City of Lodi for the particulars as to the proposed vacation.
BE IT FURTHER RESOLVED that this City Council does hereby fix Wednesday,
February 21, 2001, at the hour of 7:00 p.m., in the City Council Chambers, Carnegie Forum,
305 West Pine Street, Lodi, California, as the time and place when and where all persons
interested in or objecting to this proposed vacation may appear before this City Council and
be heard.
BE IT FURTHER RESOLVED that the Public Works Director shall cause to be posted
notices of easement vacation conspicuously along the line of the easement hereinabove
described and proposed to be vacated in the manner, form, and for the length of time set
forth in Section 8323 of the Streets and Highways Code of the State of California.
BE IT FURTHER RESOLVED that copies of this resolution shall be published for at
least two successive weeks prior to February 21, 2001 in the "Lodi News Sentinel', a daily
newspaper of general circulation printed and published in the City of Lodi, County of San
Joaquin.

A RESOLUTION OF THE LODI CITY COUNCIL
VACATING A 6 -FOOT PUBLIC UTILITY EASEMENT
ALONG THE NORTH LINE OF LOT 189, LAKEWOOD
SUBIDIVISION, UNIT NO. 4
WHEREAS, on October 13, 1976, a public utility easement dedicated along
the north line of Lot 189 as shown on "Lakewood" Subdivision, Unit No. 4, Lodi,
California was reduced to a 6 -foot public utility easement and is more particularly
described as follows and delineated on the attached map marked Exhibit A:
The North 6 -feet of Lot 189 of "Lakewood", Unit No. 4,
as filed for record on July, 26, 1967, in Book of Maps
and Plats, Volume 18, at Page 5, San Joaquin County
Records.
SAVE AND EXCEPT the West 6 -feet and East 5 -feet
of said Lot 189.
WHEREAS, the owner of Lot 189 have requested that the City of Lodi
abandon such easements; and
WHEREAS, such easements have been superseded by relocation and
there are no other public facilities located within the easement; and
WHEREAS, the Streets and Highways Code of the State of California,
Sections 8330 and 8333 provide that the legislative body of a local agency may
summarily vacate a public service easement if the easement has been
superceded by relocation and there are no other public facilities located within
the easement; and
WHEREAS, pursuant to the requirements of Government Code
§27288.1, the names of the owners of the title or interest in Lot 189 of
Lakewood Subdivision, Unit No. 4 as it appeared at the time and in the
document creating the interest, right or encumbrance is as follows:
OWNERS: Leland J. Haley and Trudy L. Haley
WHEREAS, in accordance with Streets and Highways Code Section
8300 et seq., it is the desire of the City Council of the City of Lodi to vacate
such easement.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Lodi as follows:
That the 6 -foot public utility easement located along the North property
line on Lot 189, Lakewood Subdivision, Unit No. 4, SAVE AND
EXCEPT the West 6 -feet and East 5 -feet of said Lot 189.be vacated; and
That from and after the date this resolution is recorded, such
easements will no longer constitute a public service easement.

NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN that on Wednesday, February 21, 2001 at the hour of 7:00 p.m., or as soon
thereafter as the matter may be heard, the City Council will conduct a Public Hearing at the Carnegie Forum,
305 West Pine Street, Lodi, to consider the following matter:
a) intention to vacate the 6 -foot public utility easement along the north line of lot 189, Lakewood
Subdivision, Unit No. 4
Further, notice is hereby given that the City Council has referred this item to the Planning Commission for
discussion and recommended action on Wednesday, January 24, 2001 at the hour of 7:00 p.m., or as soon
thereafter as the matter may be heard.
All interested persons are invited to present their views and comments on this matter. Written statements
may be filed with the City Clerk at any time prior to the hearing scheduled herein, and oral statements may
be made at said hearing.
If you challenge the subject matter in court, you may be limited to raising only those issues you or someone
else raised at the Public Hearing described in this notice or in written correspondence delivered to the City
Clerk, 221 West Pine Street, at or prior to the Public Hearing.
