BACKGROUND INFORMATION: The project consists of installing a trash capture device in the storm
drain line upstream from Outfall No. 4 located on the City owned
Awani Drive Property, North of Turner Road. The device is designed
to filter trash from the storm drain system before being discharged into the Mokelumne River. This project
is in response to the statewide mandate requiring trash in the City's storm drain system be collected prior
to discharging to rivers or streams.
On August 18, 2021, Council authorized the City Manager to award the contract to Soracco, Inc. for
$294,874 with the authority to execute change orders in the amount not -to -exceed $60,000. Construction
has been substantially delayed due to County permitting issues.
The City owned, Awani Drive Property is regulated by the San Joaquin County Health Department (County)
because it is a former landfill. From 1935 to 1955, the site was used as a municipal landfill which received
grass clippings, tree limbs, leaves and construction debris. Accordingly, the County directed the City to
provide a Health and Safety Work Plan prior to start of construction.
The Health and Safety Work Plan included soil testing which concluded the soil to be removed, to facilitate
installation of the proposed trash capture device, is classified as hazardous. The County has now
authorized the City to proceed with construction under the condition that all of the excavated soil be
hauled -off to a special hazardous waste landfill.
Upon receiving direction from the County to provide the Health and Safety Work Plan, Staff instructed the
contractor to postpone ordering the trash capture device until the County permitted the work. Delaying the
procurement of the trash capture device by approximately one year, coupled with recent inflation, has
resulted in an increased cost of $23,565 for the item.
The County's condition requiring the excavated soil to be disposed of at a site permitted to receive
hazardous waste has also increased the project cost. The contractor has provided a proposal to haul and
dispose of the soil in Kettleman City (the closest hazardous waste landfill) for $39,910.

The total cost of these two additional items is $63,475 which exceeds the City Manager's current change
order authority of $60,000.
If this Council action is approved, the resulting project cost will be $358,349. Since construction has yet to
begin, and additional unknown conditions are likely to be encountered at this location, Staff recommends
maintaining approximately a 20% change order contingency for construction. This would require increasing
the City Manager's not to exceed change order authority by $72,000 to $132,000. The recommended
increase will accommodate the costs associated with the County related delays ($63,475) and provide
project funding to respond to unknown conditions during construction.
Staff recommends Council adopt a resolution authorizing the City Manager to execute change orders for an
additional $72,000 for Stormwater Trash Collection Project — Phase 2 (2021).
FISCAL IMPACT: This project will move the City towards compliance by the 2030 deadline
while slightly increasing annual storm drainage maintenance costs for the
trash capture device. This project does not impact the General Fund.
FUNDING AVAILABLE: Budgeted Fiscal Year 2021/22- Wastewater Capital

RESOLUTION NO. 2022-212
A RESOLUTION OF THE LODI CITY COUNCIL AUTHORIZING THE
CITY MANAGER TO EXECUTE CHANGE ORDERS FOR
STORMWATER TRASH COLLECTION PROJECT — PHASE 2 (2021)
WHEREAS, the Stormwater Trash Collection Project Phase 2 (2021) consists of
installing a trash capture device in the storm drain line upstream from Outfall No. 4 located on
the City -owned Awani Drive Property, north of Turner Road; and
WHEREAS, on August 18, 2021, Council authorized the City Manager to award the
contract to Soracco, Inc., for $294,874 with the authority to execute change orders in an
amount not to exceed $60,000; and
WHEREAS, construction has been substantially delayed due to County permitting
issues and in that time the cost of the trash capture device has increased due to inflation; in
addition the County required the excavation and disposal of contaminated soil which increased
the project cost; and
WHEREAS, the total cost of the additional items is $63,475, which exceeds the
City Manager's current change order authority of $60,000; and
WHEREAS, staff recommends authorizing the City Manager to execute change orders
for an additional $72,000 for Stormwater Trash Collection Project — Phase 2 (2021).
NOW, THEREFORE, BE IT RESOLVED that the Lodi City Council does hereby
authorize the City Manager to execute change orders for an additional $72,000 for Stormwater
Trash Collection Project — Phase 2 (2021); and
BE IT FURTHER RESOLVED, pursuant to Section 6.3q of the City Council Protocol
Manual (adopted 11/6/19, Resolution No. 2019-223), the City Attorney is hereby authorized to
make minor revisions to the above -referenced document(s) that do not alter the compensation
or term, and to make clerical corrections as necessary.
