HomeMy WebLinkAboutAgenda Report - August 17, 2022 C-11CITY OF .�+ Z CALIFORNIA AGENDA ITEM IC401 COUNCIL COMMUNICATION AGENDA TITLE: Adopt Resolution Authorizing City Manager to Execute Addendum to the Cooperative Agreement with San Joaquin County Council of Governments for Funding Allocation for the Garfield Street Safe Route to School Project MEETING DATE: August 17, 2022 PREPARED BY: Public Works Director RECOMMENDED ACTION: Adopt resolution authorizing City Manager to execute addendum to the cooperative agreement with San Joaquin Council of Governments (SJCOG) for funding allocation for the Garfield Street Safe Route to School Project. BACKGROUND INFORMATION: The Cite received the Active Transportation Program (ATP) Cycle 5 State Grant, in the amount of $705,000, for Garfield Street Safe Route to School Project. This project will install missing sidewalks, wheelchair accessible ramps, and other incidental work on Garfield Street from Tokay Street to Poplar Street. SJCOG serves as the Regional Transportation Authority to manage the transportation funding in the county. The SJCOG Board of Directors approved the funding allocation request on March 25, 2021 and the use of State Measure K Renewal funds for this project. SJCOG and the City executed a Measure K Renewal Cooperative Agreement on October 28, 2021 for the funding allocation commitment. Originally, Staff expected to complete the project in June of 2022. Due to staffing shortages, the project was delayed. The new completion date is expected to be the end of November 2022. SJCOG requires the City to execute an addendum to the cooperative agreement for the project extension. Staff recommends authorizing City Manager _o execute addendum to the cooperative agreement with SJCOG for funding allocation for the Garfield Street Safe Route to School Project. Sponsor and Authority may each be referred to herein as "Party" or collectively as "Parties. Recitals A. On August 18, 2022 the SJCOG Board approved extending the term of Cooperative Agreement (C-22-024) for Garfield Street Safe Route To School project to June 30, 2023. B. The parties now wish to amend the original Agreement to reflect these changes. NOW, THEREFORE, in consideration of the mutual obligations in this Amendment #1 to the Measure K Cooperative Agreement, the parties to this Amendment #1 to the Measure K Cooperative Agreement agree as follows: 1.9. Completion of Project. Sponsor shall be responsible for the timely completion of the construction of the Project and provide management of consultant and contractor activities, including responsibility for schedule, budget and oversight of the services, consistent with the scope of work. Since Sponsor is responsible for project management and oversight, any and all costs which exceed $705,000 of the total eligible costs set forth in Exhibit "A" shall be the sole responsibility of Sponsor. This provision shall apply in all instances including situations where a change in scope has been approved by the Authority pursuant to Section 1.2. 1.9.a. Letter of Project Completion. Sponsor shall provide a letter of project completion which includes final cost, revenues, schedule of activities, etc. This letter shall accompany the final invoice for payment from the sponsor to provide notice of project account closing by Authority. NOW, THEREFORE, BE IT RESOLVED that the Lodi City Council does hereby authorize the City Manager to execute Addendum No. 1 to the Measure K Renewal Cooperative Agreement with SJCOG for funding allocation for the Garfield Street Safe Route to School Project; and BE IT FURTHER RESOLVED, pursuant to Section 6.3q of the City Council Protocol Manual (adopted 11/6/19, Resolution No. 2019-223), the City Attorney is hereby authorized to make minor revisions to the above -referenced document(s) that do not alter the compensation or term, and to make clerical corrections as necessary.
