RECOMMENDED ACTION: Approve Request Awarding Concession Operations at Armory Park and
Softball Complex to Out of Play Concessions with a Return to the City of 24%
of Gross Sales from Concession Operations.
BACKGROUND INFORMATION: Concession operations at the Softball Complex and Armory Park are
operated by contract for the purpose of servicing adult league players,
and youth, teen and adult players at weekend tournaments throughout
the season.
Two bids were received this year for a three-year contract, with Out of Play Concessions bidding 24% at both
facilities, and Food & Fun Concessions bidding 21% at the Softball Complex and 6% at Armory Park. Food &
Fun Concessions contract has recently expired, which they received in 1998. At that time, they were the only
bidder, with payments at 27% at the Complex and 12% at Armory Park. Food & Fun has been the contract
concessionaire since 1992, when they bid 25% at both locations.
Out of Play Concessions is owned by previous employees of Food & Fun, and their principal owner has
managed the Lodi operation for the last several years. Staff, in consultation with Joel Harris, Purchasing
Agent for the City, has determined that Out of Play Concessions meets all the requirements of the bid.
FUNDING: No funding impact on the City.

RESOLUTION NO. 2001-39
A RESOLUTION OF THE LODI CITY COUNCIL AWARDING
THE CONTRACT FOR CONCESSION OPERATIONS AT
ARMORY PARK AND THE SOFTBALL COMPLEX
WHEREAS, on January 17, 2001, the City Council authorized staff to solicit
proposals for concession operations at Armory Park and the Softball Complex for a two-
year period; and
WHEREAS, two proposals were received by the deadline; and
WHEREAS, the proposals were evaluated on the basis of experience in
concession operations, reputation and percentage of gross receipts returned to the City;
and
WHEREAS, it is staff recommendation that the City Council award the contract
to Out of Play Concessions, of Stockton, California, for the period of March 1, 2001
through December 31, 2003 for a return of 24% of gross sales from each Concession
operation.
NOW, THEREFORE, BE IT RESOLVED, that the Lodi City Council does hereby
award the contract for concession operations at Armory Park and the Softball Complex
to Out of Play Concessions, of Stockton, CA, for the period March 1, 2001 through
December 31, 2003, for a return of 24% of gross sales from each Concession operation.
