AGENDA TITLE: Adopt Resolution Approving a Salary Differential of Five Percent for Unrepresented/
Confidential Classifications That Have a Represented Counterpart

RECOMMENDED ACTION: Adopt resolution approving a salary differential of five percent for
unrepresented/confidential classifications that have a represented
counterpart.
BACKGROUND INFORMATION: Historically, the City provided a five percent salary differential between
positions within the unrepresented/confidential groups over that of their
represented counter parts.
Over the past few years, the City created new unrepresented/confidential classifications and reactivated one
classification. The salary ranges for the unrepresented/confidential classifications were implemented without
providing the historical five percent salary differential between the unrepresented position and the represented
position. In addition, other unrepresented/confidential classifications have been filled for a number of years
where the differential has not been provided. City staff propose to provide the differential for all impacted
unrepresented/confidential positions.
Unrepresented classifications are those that are not represented by a recognized labor or professional
organization. Employees in these classifications do not have an association or union that bargains on their
behalf and they are not governed by a collective bargaining agreement. Confidential positions are positions that
ordinarily would be part of a bargaining unit, but have been removed from the represented bargaining unit to
prevent a fundamental conflict of interest that would undermine the employer -union relationship in the collective
bargaining process. A Confidential employee has access to confidential information relating to the City's
administration of employer-employee relations and bargaining. Unrepresented/Confidential positions typically
reside in the City Manager's Office, the City Attorney's Office, and the Human Resources and Budget Divisions
of the Internal Services Department.
Staff proposes to adjust the salary ranges for the unrepresented/confidential classifications to provide a five
percent salary differential over that of the salary range for represented classifications. This five percent
differential will be in addition to any other wage differences that occurred due to varying CalPERS cost-sharing
agreements between represented positions and unrepresented positions. The differential will not be provided to
single unrepresented/confidential classifications that do not have a represented counter part (i.e., Human
Resources Manager).

Staff recommends that Council approve the Resolution to provide a five percent salary differential for the above
listed classifications and for other Council approved unrepresented/confidential classifications.
FISCAL IMPACT: The annual cost of the proposed resolution is approximately $20,000 and impacts
a total of eight unrepresented/confidential employees
FUNDING AVAILABLE: All additional costs will be absorbed within existing appropriations.

A RESOLUTION OF THE LODI CITY COUNCIL APPROVING A
FIVE PERCENT SALARY DIFFERENTIAL
FOR UNREPRESENTED/CONFIDENTIAL JOB
CLASSIFICATIONS ABOVE REPRESENTED CLASSFICATIONS
WHEREAS, the City has represented and unrepresented/confidential job classifications
within the classification plan; and
WHEREAS, employees in the unrepresented/confidential classifications do not have an
association or union that bargains on their behalf and they are not governed by a collective
bargaining agreement; and
WHEREAS, unrepresented/confidential positions are positions that ordinarily would be
part of a bargaining unit, but have been removed from the represented bargaining unit to
prevent a fundamental conflict of interest that would undermine the employer -union relationship
in the collective bargaining process; and
WHEREAS, an unrepresented/confidential employee has access to confidential
information relating to the City's administration of employer-employee relations and bargaining;
and
WHEREAS, it is recommended that Council approve revisions to the salary schedule to
provide a five percent (5%) differential for Council approved unrepresented/confidential job
classifications where there is a comparable represented position; and
WHEREAS, the five percent differential is in addition to any other salary variations
between classifications due to different CalPERS cost-sharing amounts.
NOW, THEREFORE, BE IT RESOLVED that the Lodi City Council does hereby approve
a five percent salary differential for unrepresented/confidential classifications as listed in
Exhibit A.
