HomeMy WebLinkAboutMinutes - June 28, 2022 SMLODI CITY COUNCIL SPECIAL CITY COUNCIL MEETING CARNEGIE FORUM, 305 WEST PINE STREET TUESDAY, JUNE 28, 2022 The City Council Closed Session meeting of June 28, 2022, was called to order by Mayor Chandler at 7:00 a.m. Present: Council Member Khan, Council Member Kuehne, Mayor Pro Tempore Hothi, and Mayor Chandler Absent: Council Member Nakanishi Also Present: Deputy City Manager Keys, City Attorney Magdich, and City Clerk Nashed Council Member Nakanishi joined the meeting at 7:01 a.m. At 7:01 a.m., Mayor Chandler adjourned the meeting to a Closed Session to discuss the above matters. The Closed Session adjourned at 7:26 a.m. At 7:26 a.m., Mayor Chandler reconvened the City Council meeting, and City Attorney Magdich disclosed the following actions. Item C-2a) was discussion and direction given with no further reportable action. The Special City Council meeting of June 28, 2022, was called to order by Mayor Chandler at 7:26 a.m. Present: Council Member Khan, Council Member Kuehne, Council Member Nakanishi, Mayor Pro Tempore Hothi, and Mayor Chandler Absent: None Also Present: Deputy City Manager Keys, City Attorney Magdich, and City Clerk Nashed Council Member Nakanishi made a motion, second by Mayor Pro Tempore Hothi, to approve the C-1 Call to Order / Roll Call C-2 Announcement of Closed Session a) Pending Litigation: Government Code §54956.9(a). One Case. City of Lodi v. Shell Oil Company, et al., San Joaquin County Superior Court, Case No. STK-CV-UETT-2020- 9894; Judicial Council Coordination Proceeding 4435 –TCP Cases, San Bernardino County Superior Court, Case No. JCPSS4435/SCVSS12067 (CA) C-3 Adjourn to Closed Session C-4 Return to Open Session / Disclosure of Action A.Call to Order / Roll Call B. Consent Calendar (Reading; Comments by the Public; Council Action) All matters listed on the consent calendar are considered to be routine and will be acted upon by one motion. There will be no separate discussion of these items. If a member of the public would like a consent calendar item pulled and discussed separately, refer to the Notice at the beginning of this agenda. 1 following items hereinafter set forth, in accordance with the report and recommendation of the City Manager. VOTE: The above motion carried by the following vote: Ayes: Council Member Khan, Council Member Kuehne, Council Member Nakanishi, Mayor Pro Tempore Hothi, and Mayor Chandler Noes: None Absent: None Adopted Resolution No. 2022-166 authorizing the City Manager to waive the bid process and purchase ultra violet parts from Trojan Technologies Group, ULC, a sole-source vendor, of London, Ontario, in the amount of $135,623. None. Contract Planner Paul Junker provided a PowerPoint presentation regarding the Municipal Services Review (MSR) and Sphere of Influence (SOI) updates. Specific topics of discussion included the approval process for MSR and SOI documents, the content and purpose of the MSR the current area that is included in Lodi's SOI, the proposed areas to be added to the SOI, and a possible Area of Interest extending from the City of Lodi boundary to about half a mile south of Armstrong Road. Contract Planner Junker provided an explanation regarding two different methods for the Area of Interest to be added to the MSR and SOI. The first direction would be to approve the draft MSR and SOI documents and forwarded them to Local Agency Formation Commission (LAFCo) and subsequently begin discussion with San Joaquin County and City of Stockton regarding the Area of Interest to be added to Lodi's Sphere of Influence. The second direction would be to consider adding the Area of Interest to the MSR and SOI now, which may cause a delay in the MSR and SOI being approved by LAFCo. Council discussion ensued with Deputy City Manager Keys and Contract Planner Junker regarding land development within the Area of Interest, the possibility of migration from the City of Stockton to City of Lodi, notifying the Armstrong Road property owners of including the Area of Interest into the City of Lodi SOI, and the impact of expanding west of City of Lodi boundaries to Interstate 5 north of Armstrong Road. Council Member Khan made a motion, second by Council Member Kuehne, to adopt a resolution approving updated Municipal Services Review and proposed Sphere Of Influence, including the B-1 Adopt Resolution Authorizing City Manager to Waive Bid Process and Purchase Ultra Violet Parts from Trojan Technologies Group, ULC, a Sole-Source Vendor, of London, Ontario ($135,623) (PW) C.Comments by the Public on Non-Agenda Items THE TIME ALLOWED PER NON- AGENDA ITEM FOR COMMENTS MADE BY THE PUBLIC IS LIMITED TO FIVE MINUTES. D.Regular Calendar D-1 Adopt Resolution Approving Updated Municipal Services Review and Proposed Sphere of Influence and Direct Staff to Submit Such Documents to San Joaquin Local Agency Formation Commission (LAFCo) for Formal Review and Action (CD) 2 Area of Interest that extends from the southern boundary of the City of Lodi to a half mile south of Armstrong Road and direct staff to submit such documents to San Joaquin Local Agency Formation Commission (LAFCo) for formal review and action. VOTE: The above motion failed by the following vote: Ayes: Council Member Khan, and Council Member Kuehne Noes: Council Member Nakanishi, Mayor Pro Tempore Hothi, and Mayor Chandler Absent: None Further discussion ensued with Deputy City Manager Keys, Community Development Director John Della Monica, and Contract Planner Junker regarding the timeline of the MSR and SOI getting approved by LAFCo, if the Area of Interest was incorporated into the documents now. Mayor Pro Tempore Hothi made a motion, second by Mayor Chandler, to adopt Resolution No. 2022-167 approving the updated Municipal Services Review and proposed Sphere of Influence and directing staff to submit such documents to the San Joaquin Local Agency Formation Commission (LAFCo) for formal review and action. VOTE: The above motion carried by the following vote: Ayes: Council Member Nakanishi, Mayor Pro Tempore Hothi, and Mayor Chandler Noes: Council Member Khan, and Council Member Kuehne Absent: None Consensus was given to staff to initiate discussion with City of Stockton and San Joaquin County regarding the Area of Interest.
