HomeMy WebLinkAboutMinutes - June 1, 2022LODI CITY COUNCIL REGULAR CITY COUNCIL MEETING CARNEGIE FORUM, 305 WEST PINE STREET WEDNESDAY, JUNE 1, 2022 The City Council Closed Session meeting of June 1, 2022, was called to order by Mayor Pro Tempore Hothi at 6:46 p.m. Present: Council Member Kuehne, and Mayor Pro Tempore Hothi Absent: Council Member Khan, Council Member Nakanishi, and Mayor Chandler Also Present: City Manager Schwabauer, City Attorney Magdich, and City Clerk Nashed At 6:46 p.m., Mayor Pro Tempore Hothi adjourned the meeting to a Closed Session to discuss the above matters. No matters were discussed until Councilmember Khan joined Closed Session at 6:57 p.m. The Closed Session adjourned at 6:59 p.m. At 7:00 p.m., Mayor Pro Tempore Hothi reconvened the City Council meeting, and City Attorney Magdich disclosed the following actions. Item C-2a) was discussion and direction was give with no reportable action. The Regular City Council meeting of June 1, 2022, was called to order by Mayor Pro Tempore Hothi at 7:00 p.m. Present: Council Member Khan, Council Member Kuehne, and Mayor Pro Tempore Hothi Absent: Council Member Nakanishi, and Mayor Chandler Also Present: City Manager Schwabauer, City Attorney Magdich, and City Clerk Nashed Mayor Chandler joined the meeting 7:03 p.m. C-1 Call to Order / Roll Call C-2 Announcement of Closed Session a) Conference with Adele Post, Human Resources Manager, and Andrew Keys, Deputy City Manager (Labor Negotiators), Regarding Lodi City Mid-Management Association, AFSCME General Services and Maintenance & Operators, Police Mid-Managers, Lodi Police Officers Association, Lodi Police Dispatchers Association, Lodi Professional Firefighters, Lodi Fire Mid-Management, International Brotherhood of Electrical Workers, Confidential General Services, Confidential Mid-Managers, Executive Managers, and Appointed Employees Pursuant to Government Code §54957.6 (CM) C-3 Adjourn to Closed Session C-4 Return to Open Session / Disclosure of Action A.Call to Order / Roll Call H.Regular Calendar H-1 Adopt Resolution Approving Fiscal Year 2022/23 Financial Plan and Budget; Approving Fiscal Year 2022/23 Appropriation Spending Limit; Approving Classification, Job Description and Salary Range of New Administrative Analyst (Confidential and 1 Deputy City Manager Andrew Keys provided a PowerPoint presentation regarding the Fiscal Year 2022/23 budget. Specific topics of discussion included overview, position requests, Capital Improvement Project Program, all funds expenditures, use of revenue increases for one-time purposes, and recommended action. Parks and Recreation Commissioner Mike Carouba provided public comment on the item. Mayor Chandler made a motion, second by Council Member Kuehne, to adopt Resolution No. 2022-133 approving Fiscal Year 2022/23 Financial Plan and Budget; approving Fiscal Year 2022/23 Appropriation Spending Limit; approving classification, job description and salary range of new Administrative Analyst (Confidential and Represented); and approving Fiscal Year 2022/23 Investment Policy. VOTE: The above motion carried by the following vote: Ayes: Council Member Khan, Council Member Kuehne, Mayor Pro Tempore Hothi, and Mayor Chandler Noes: None Absent: Council Member Nakanishi ROLL CALL VOTE The City Council held a ROLL CALL vote (all voiced their votes). Mayor Chandler left the meeting at 7:27 p.m. Mayor Pro Tempore Hothi presented a proclamation in honor of State Farm's 100th anniversary to Pam Aberle, of State Farm. Pam Aberle thanked Council for the proclamation. Mayor Pro Tempore Hothi presented a proclamation to Kat Ellis, of A New Lodi, proclaiming June 2022 as PRIDE month in the City of Lodi. Kat Ellis thanked Council for the proclamation. Mayor Pro Tempore Hothi presented a proclamation to Jose Ordaz, supervisor for San Joaquin County Adult Protective Services, proclaiming June 2022 as Elder Abuse and Dependent Adult Abuse Awareness Month in the City of Lodi. Jose Ordaz thanked Council for the proclamation. Represented); and Approving Fiscal Year 2022/23 Investment Policy (ISD) B.Presentations B-1 State Farm’s 100th Anniversary Proclamation (CLK) B-2 PRIDE Month Proclamation (CLK) B-3 Elder Abuse and Dependent Adult Abuse Awareness Month (CLK) C.Consent Calendar (Reading; Comments by the Public; Council Action) All matters listed on the consent calendar are considered to be routine and will be acted upon by one motion. 2 Council Member Khan made a motion, second by Council Member Kuehne, to approve the following items hereinafter set forth, in accordance with the report and recommendation of the City Manager. VOTE: The above motion carried by the following vote: Ayes: Council Member Khan, Council Member Kuehne, and Mayor Pro Tempore Hothi Noes: None Absent: Council Member Nakanishi, and Mayor Chandler Claims were approved in the amount of $5,391,823.74. The minutes of April 20, 2022 (Regular Meeting), May 3, 2022 (Shirtsleeve Session), May 4, 2022 (Regular Meeting), and May 10, 2022 (Shirtsleeve Session) were approved as written. Adopted Resolution No. 2022-134 authorizing a motorcycle trade-in and replacement purchase from Long Beach BMW, of Long Beach, and appropriate funds in the amount of $34,899. Adopted Resolution No. 2022-135 authorizing the City Manager to execute change orders to 2021-2023 Sidewalk and Miscellaneous Concrete Repair Program, in an amount not to exceed $201,000, and appropriating funds in the amount of $180,000. Adopted Resolution No. 2022-136 authorizing the City Manager to execute a contract amendment for 2021-2022 Asphalt Materials in the amount of $63,333. Adopted Resolution No. 2022-137 authorizing the City Manager to execute a Professional Services Agreement for renewal of IVR hosted monthly subscription and support with Milsoft Utility Solutions, of Abilene, Texas, in the amount of $40,000 per year. There will be no separate discussion of these items. If a member of the public would like a consent calendar item pulled and discussed separately, refer to the Notice at the beginning of this agenda. Adopted Resolution No. 2022-139 authorizing the City Manager to execute a change order to the second one-year optional extension to the Professional Services Agreement with The Pun Group, LLP, of Santa Ana, to add funds for new single audit requirements, in an amount not to exceed $90,192 for Fiscal Year 2021-22 audit and $422,156 for the life of the contract. Adopted Resolution No. 2022-140 authorizing the City Manager to execute Confirmation 0250 under Support Services Program Agreement with Northern California Power Agency (NCPA) and Task Order ESG-NCPA-LODI03 with NCPA and Southern California Public Power Authority for Keep Your Cool Commercial Refrigeration Program, in the amount of $52,830. Adopted Resolution No. 2022-141 updating previous resolution to add the position of Public Information Officer to response personnel list to receive portal-to-portal reimbursement for Office of Emergency Services Mutual Aid. Adopted Resolution No. 2022-142 approving the Lower Sacramento Road Pavement Resurfacing Project for Road Repair and Accountability Act of 2017 funding for Fiscal Year 2022/23. Adopted Resolution No. 2022-143 initiating proceedings for the levy and collection of assessments, Resolution No. 2022-144 approving the Annual Report, and Resolution No. 2022- 145 declaring the intention to levy and collect assessments for Lodi Consolidated Landscape Maintenance Assessment District No. 2003-1 for Fiscal Year 2022/23; and set a public hearing for July 20, 2022. Rhonda Prizmich provided public comment, praying for the City of Lodi. Pete Valdez provided public comment regarding mask requirements on public transportation. Council Member Kuehne provided an update on projects discussed during his SJCOG's One Voice trip to Washington D.C. Council Member Khan congratulated A New Lodi, inquired about City action regarding cars parked on street during trash collection days and overgrown grass in residential neighborhoods. Chief of Police Sierra Brucia addressed Council Member Khan's concerns by stating that residents are able to call the Police Department with their concerns, Police volunteers will be resuming proactive measures regarding abandoned vehicles, and Community Improvement Division efforts within the City. Council Member Khan further requested office space for City Council within City Hall. City Manager Schwabauer confirmed that there is office space within City Hall for Council Members to conduct business. City Manager Schwabauer confirmed that the City of Lodi does not have a mask requirement on its bus system. C-13 Set Public Hearing for June 15, 2022 to Consider Ordinance Amending Lodi Municipal Code Title 17–Development Code, Chapter 17.34.060.A.3, “GC and Industrial Districts” to Revise Standards for Signs in These Zoning Districts, and Adding Section 17.34.070.H, “Electronic Message Signs on City Property” to Create a New Type of Advertising Sign Located on City-Owned Property (CD) C-14 Adopt Resolution Initiating Proceedings for Levy and Collection of Assessments, Resolution Approving Annual Report, and Resolution Declaring Intention to Levy and Collect Assessments for Lodi Consolidated Landscape Maintenance Assessment District No. 2003-1 for Fiscal Year 2022/23; and Set Public Hearing for July 20, 2022 (PW) D.Comments by the Public on Non-Agenda Items THE TIME ALLOWED PER NON-AGENDA ITEM FOR COMMENTS MADE BY THE PUBLIC IS LIMITED TO FIVE MINUTES. Comments by the City Council Members on Non-Agenda Items F.Comments by the City Manager on Non-Agenda Items 5 Human Resources Manager Adele Post provided a brief report regarding the Memorandum of Understanding with the Police Officers Association of Lodi (POAL). Specific topics of discussion included term of MOU, wage adjustments, medical premium, dental benefits, and wellness programs. Council Member Kuehne made a motion, second by Council Member Khan, to adopt Resolution No. 2022-146 approving the Memorandum of Understanding between City of Lodi and Police Officers Association of Lodi for the period July 1, 2022 through June 30, 2025. VOTE: The above motion carried by the following vote: Ayes: Council Member Khan, Council Member Kuehne, and Mayor Pro Tempore Hothi Noes: None Absent: Council Member Nakanishi, and Mayor Chandler Council Member Khan made a motion, second by Council Member Kuehne, (following reading of the title) to waive reading of the ordinance in full and adopt and order to print Ordinance No. 2001 entitled, "An Ordinance of the Lodi City Council Amending Lodi Municipal Code Article 2 - Administration and Personnel - by Adding Chapter 2.26, 'Military Equipment Use Policy,' to Provide for the Lodi Police Department's Adoption of a Military Equipment Use Policy in Accordance with AB 481," which was introduced at a regular meeting of the Lodi City Council held May 18, 2022. VOTE: The above motion carried by the following vote: Ayes: Council Member Khan, Council Member Kuehne, and Mayor Pro Tempore Hothi Noes: None Absent: Council Member Nakanishi, and Mayor Chandler Council Member Kuehne made a motion, second by Council Member Khan, (following reading of the title) to waive reading of the ordinance in full and adopt and order to print Ordinance No. 2002 entitled, "An Ordinance of the Lodi City Council Amending Lodi Municipal Code Title 13 - Public Services - by Repealing and Reenacting Chapter 13.16, 'Solid Waste,' in Its Entirety," which was introduced at a regular meeting of the Lodi City Council held May 18, 2022.
