RECOMMENDED ACTION: Set public hearing for May 18, 2022, introducing ordinance
amending Lodi Municipal Code Title 13 "Public Services," by
repealing and reenacting Chapter 13.16 "Solid Waste" in its entirety.
BACKGROUND INFORMATION: SB 1382, enacted in 2016, is the latest in a series of bills since 2006 to
reduce the impact of greenhouse emissions in California. Specifically
addressed in SB 1383 is the production of methane
by organic materials in landfills. SB 1383 has mandated the reduction of organic material in landfills and
directed the California Department of Resources and Recycling and Recovery (CalRecycle) to develop
regulations that would meet these mandates.
The regulations developed require local jurisdictions to implement actions and enforce requirements on
residents and businesses. Some of the requirements were to be in place by January 1, 2022, with the rest
phasing in through 2024. Recognizing that agencies may need more time to develop organics recycling
programs, the Governor signed AB 619 in 2021 authorizing agencies to extend the SB 1383 implementation
date by filing a Notice of Intent to Comply (NOIC) with CalRecyle.
The City has recently filed the NOIC providing the City until January 1, 2023 to implement these requirements.
The option to file the NOIC is conditional upon each jurisdiction to adopt an enforceable ordinance mandating
that waste generators, collectors, and other entities change the ways in which they collect, manage and
process organic waste. This proposed ordinance will allow the City to enforce SB 1383 requirements on
businesses and residents beginning on January 1, 2024 that is required by SB 1383 regulations.
At its meeting on March 16, 2022, City Council accepted this amendment to the ordinance. Due to an
oversight, a required section was left out related to the requirements of commercial edible food generators.
This subsequent amendment would add the State required section covering commercial edible food
generators and its related definitions.
FISCAL IMPACT: City could face fines from the State if an enforcement ordinance is not adopted.
FUNDING AVAILABLE: Not applicable.

NOTICE IS HEREBY GIVEN that on Wednesday, May 18, 2022, at the hour of

conduct a public hearing at the Carnegie Forum, 305 West Pine Street, Lodi, to consider
the following item:
