BACKGROUND INFORMATION: The City Council, on December 2, 2009, approved Ordinance 1827, which established regulations for the mobile sale of food on both public and private property. The intent of the regulations (codified as Chapter 9.18 of the Lodi Municipal Code) was to, "... provide those persons who engage in those types of vending operations with clear and concise regulations to prevent safety, traffic, and health hazards, as well as to preserve the peace, safety, and welfare of the community." [Ordinance 1827] Included in the regulations adopted at the time were limits on two types of "food trucks": 9.18.045 - Permit caps. A. The total number of vendor permits issued pursuant to this section shall not exceed the numbers set forth below: 1. Motorized food preparation units: 22 2. Produce/seafood trucks: 3 [Lodi Municipal Code] The types of trucks are defined as follows in the Lodi Municipal Code: APPROVED: Steve $c h wa b a u e r Stephen Schwabauer, City Manager PH Food Truck Permit Cap Amend 9.18.045 April 20, 2022 Page 2 of 3 "Food Preparation Unit": "... means any vehicle or trailer and vehicle combination as defined in Section 670 of the California Vehicle Code which is equipped to: 1. Prepare and sell; or 2. Cook and sell food products." "Produce/Seafood Truck":... means any vehicle as defined by Section 670 of the California Vehicle Code which sells raw produce or seafood." These permit limits have not changed since the adoption of Ordinance 1827 almost 13 years ago. At this time, all of the available permits have been issued, and no additional food preparation units or produce/seafood trucks can be licensed to operate in the City. The City continues to receive regular inquiries from new operators seeking to obtain a permit to operate in Lodi; these requests are currently denied due to the lack of available permits. PROPOSED REGULATIONS In response to a desire to increase the number of permitted food trucks' in Lodi, staff has prepared the attached amendment to the Municipal Code. The proposed changes would replace the flat cap on the number of food truck permits with a cap based on the population of Lodi. To create the proposed variable cap, staff determined the population of Lodi in 2007, the year when the City's food truck regulations were first proposed. This figure (61,648, per the State of California Department of Finance) was then divided by the initial number of food preparation unit and produce/seafood permits, as follows to determine the number of persons per permit: ■ Food Preparation Units: 61,648/22 = 2,802 (rounded to 2,800 in the proposed changes) • Produce/Seafood Trucks: 61,648/3 = 20,549 (rounded to 20,550 in the proposed changes) Applied to the City's current population of 68,751 (as of Jan 1, 2021, per the State of California Department of Finance), the revised number of available permits would increase as shown below: • Food Preparation Units: 68,751/2,800 = 24.55 (rounded to the nearest whole number: 25) • Produce/Seafood Trucks: 68,751/20,550 = 3.34 (rounded to the nearest whole number: 3) As shown, the number of "food preparation unit" permits would increase from 22 to 25 under the proposed changes. The number of produce/seafood truck permits would remain unchanged (an increase in population to 73,980 would be required to allow an additional produce/seafood permit). The increase in the number of "food preparation unit" permits is modest, but retains the trucks/capita ratio which existed at the time the original caps were adopted. Under the proposed regulations, the Community Development Department would verify the City's population as estimated by the State of California Department of Finance each year and use the ratios in the regulations to determine the number of permits which can be issued. The new permit cap would be reported to other City departments and the public; no action by the City Council would be needed. Lodi Municipal Code Title 9 — Public Peace, Morals and Welfare — Chapter 9.18 "Vending on Streets, Sidewalks and Private Property", Section 9.18.045, "Permit Caps," is hereby repealed and reenacted to read as follows: A. The total number of vendor permits issued pursuant to this section shall not exceed the numbers vet forth Belo following limits: 1. The number of residents used to determine the number of motorized food preparation units and produce/seafood trucks shall be the population figure for Lodi as shown in the "January Population and Housing Estimate" prepared by the State of California Department of Finance. 4. The number of allowed permits shall be a whole number. The number which results from the calculations defined above shall be rounded up or down to the closest whole number. 5. The Community Development Department shall prepare and circulate updated permit limits every year as soon as possible after the January Population and Housing Estimate is published by the State of California. B. In the event a vendor permit issued pursuant to this chapter is either revoked or is allowed by its holder to expire it shall immediately become null and void and shall be forfeited. Any permit forfeited under this chapter shall be available to any other person who first complies with all other applicable provisions of this chapter and this code. C. In the event the holder of any vendor permit under this chapter ceases operations in Lodi, any permits issued pursuant to this section shall be transferable provided that the transferee meets all other provisions of this chapter. In the event of a sale, the seller's vendor permit shall immediately become null and void and the seller shall no longer conduct business pursuant to this chapter. Within five business days of any sale or transfer, the seller shall notify the city of such sale and shall provide any proof of sale as may be required by the city. SECTION 2. No Conflict. All ordinances and parts of ordinances in conflict herewith are repealed insofar as such conflict may exist. SECTION 3. No Mandatory Duty of Care. This ordinance is not intended to and shall not be construed or given effect in a manner which imposes upon the City, or any officer or employee thereof, a mandatory duty of care toward persons or property within the City or outside of the City so as to provide a basis of civil liability for damages, except as otherwise imposed by law. SECTION 4. Severability. If any provision of this ordinance or the application thereof to any person or circumstances is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application. To this end, the provisions of this ordinance are severable. The City Council hereby declares that it would have adopted this ordinance irrespective of the invalidity of any particular portion thereof. SECTION 5. Effective Date and Publication. This Ordinance shall take effect thirty (30) days after its adoption. In lieu of publication of the full text of the Ordinance within fifteen (15) days after its passage, a summary of the Ordinance may be published at least five (5) days prior to and fifteen (15) days after adoption by the City Council, and a certified copy shall be posted in the office of the City Clerk pursuant to Government Code section 36933(c)(1).
