AGENDA TITLE: Accept Project Under Contract for Lodi Lake Riverbank Stabilization Project

RECOMMENDED ACTION: Accept improvements for Lodi Lake Riverbank Stabilization Project.
BACKGROUND INFORMATION: A portion of the riverbank on the Mokelumne River that runs along the
northern boundary of Lodi Lake Park, had become severely eroded in
past years and was threatening adjacent park facilities. The erosion
had exposed irrigation lines, tree roots, and caused the collapse of concrete retaining wall structures.
The project included clearing, grubbing, selective tree removal and trimming, concrete slope protection
removal and replacement, sod installation, tree planting, and other miscellaneous and related work as
shown on the plans and specifications for the project.
The project was award to ASTA Construction Company, Inc. of Rio Vista on December 1, 2021, in the
amount of $541,013.00 and the final contract price is $595,580.86. The cost increase was due to two
change orders and the final bid item quantity difference.
Change Order No. 1 ($33,046.57) was to accelerate the rock slope protection placement in the river below
the normal highwater level in February so the work in the river could be completed before Woodbridge
Irrigation District (WID) raised their dam on the river in March. WID agreed to delay the dam raising for one
week to accommodate the City's schedule.
Change Order No. 2 ($14,067.50) was to remove a large fallen tree in the work area after the rock slope
protection was installed. Additional top soil and rock protection was required to fill the large void the fallen
tree left behind.
In addition to Change Orders No. 1 and No. 2, minor differences in contract line item quantities amounted
to an additional $7,453.79.
Overall the project was successful in reinforcing the riverbank erosion protection and new native trees were
planted along the riverbank. This will provide years of erosion protection and the trees will provide habitat
for the birds and fish along the river.
Following acceptance by the City Council, as required by law, the City Engineer will file a Notice of
Completion with the County Recorder's office. The notice serves to notify vendors and subcontractors that
the project is complete and begins their 30 -day period to file a stop notice requiring the City to withhold
payments from the prime contractor in the event of a payment dispute.

authority of $50,040 by $4,567.86. Staff is recommending adopting a resolution authorizing Citv
Manager to execute chancre order in the amount of $4.567.86 to cover the contract item quantities
adjustment.

RESOLUTION NO. 2022-90
A RESOLUTION OF THE LODI CITY COUNCIL AUTHORIZING THE
CITY MANAGER TO EXECUTE A CHANGE ORDER WITH
ASTA CONSTRUCTION COMPANY, INC., OF RIO VISTA, FOR
LODI LAKE RIVERBANK STABILIZATION PROJECT
WHEREAS, the Lodi Lake Riverbank Stabilization Project included clearing, grubbing,
selective tree removal and trimming, concrete slope protection removal and replacement, sod
installation, tree planting, and other miscellaneous and related work, as shown on the plans and
specifications for the project; and
WHEREAS, the project was awarded to ASTA Construction Company, Inc., of Rio Vista
on December 1, 2021, in the amount of $541,013.00 and the final contract price is $595,580.86;
and
WHEREAS, Change Order No. 1 ($33,046.57) was to accelerate the rock slope
protection placement in the river below the normal high-water level in February so the work in
the river could be completed before Woodbridge Irrigation District raised their dam on the river
in March; and
WHEREAS, Change Order No. 2 ($14,067.50) was to remove a large fallen tree in the
work area after the rock slope protection was installed. Additional top soil and rock protection
was required to fill the large void the fallen tree left behind; and
WHEREAS, in addition to Change Orders No. 1 and No. 2, minor differences in contract
line item quantities amounted to an additional $7,453.79, which exceeds the originally -approved
City Manager's change order authority of $50,000 by $4,567.86; and
WHEREAS, staff recommends authorizing the City Manager to execute a change order
in the amount of $4,567.86 to cover the contract item quantities adjustment.
NOW, THEREFORE, BE IT RESOLVED that the Lodi City Council does hereby
authorize the City Manager to execute a change order with ASTA Construction Company, Inc.,
of Rio Vista, California, for the Lodi Lake Riverbank Stabilization Project, in the amount of
$4,567.86, to cover the contract item quantities adjustment; and
BE IT FURTHER RESOLVED, pursuant to Section 6.3q of the City Council Protocol
Manual (adopted 11/6/19, Resolution No. 2019-223), the City Attorney is hereby authorized to
make minor revisions to the above -referenced document(s) that do not alter the compensation
or term, and to make clerical corrections as necessary.
