AGENDA TITLE: Adopt Resolution Authorizing City Manager to Waive Bid Process and Purchase One
Commander 4000 Series Electric Utility Line Truck from Terex Utilities, Inc. of Stockton
($300,000)

RECOMMENDED ACTION: Adopt a resolution authorizing the City Manager to waive the bid process
and purchase one Commander 4000 Series Electric Utility Line Truck from
Terex Utilities, Inc. of Stockton in an amount not to exceed $300,000.
BACKGROUND INFORMATION: Lodi Electric Utility (LEU) currently utilizes a 2014 Digger Derrick line
truck (Vehicle No. 09-001-14) to perform wood pole maintenance and
construction activities associated with the electric distribution system.
This vehicle is used on a regular basis and has exceeded the life expectancy for this type of equipment.
Repair costs total $22,474. This vehicle is critical to ensuring safe, reliable electric service for LEU customers
and unfortunately, it is subject to constant hydraulic and safety issues as well as frequent malfunction of
controls unable to be repaired.
Per Lodi Municipal Code Section 3.20.045, State and Local Agency Contracts, the bidding process may be
waived when it is advantageous for the City, with appropriate approval by the City Manager and City Council,
to use contracts that have been awarded by other California public agencies, provided that its award was in
compliance with their formally adopted bidding or negotiation procedures.
Therefore, staff recommends authorizing the City Manager to waive the bid process and purchase one
Commander 4000 Series Electric Utility Line Truck from Terex Utilities, Inc. of Stockton in an amount not to
exceed $300,000, using the competitively bid Sourcewell Contract No. 012418 -ALT.
FISCAL IMPACT: Not to exceed $300,000. This purchase does not impact the General Fund.
FUNDING AVAILABLE: Fiscal Year 2021/22 Account No. 50199000.77040.

A RESOLUTION OF THE LODI CITY COUNCIL AUTHORIZING THE
CITY MANAGER TO WAIVE THE BID PROCESS AND PURCHASE ONE
COMMANDER 4000 SERIES ELECTRIC UTILITY LINE TRUCK FROM
TEREX UTILITIES, INC., OF STOCKTON, UTILIZING
SOURCEWELL CONTRACT NO. 012418 -ALT
WHEREAS, Lodi Electric Utility (LEU) currently utilizes a 2014 Digger Derrick line truck
(Vehicle No. 09-001-14) to perform wood pole maintenance and construction activities associated
with the electric distribution system; and
WHEREAS, this vehicle is used on a regular basis and has exceeded the life expectancy
for this type of equipment with repair costs to date totaling $22,474; and
WHEREAS, this vehicle is critical to ensuring safe, reliable electric service for LEU
customers and unfortunately, it is subject to constant hydraulic and safety issues as well as
frequent malfunction of controls unable to be repaired; and
WHEREAS, per Lodi Municipal Code Section 3.20.045, State and Local Agency

NOW, THEREFORE, BE IT RESOLVED that the Lodi City Council does hereby authorize
the City Manager to waive the bid process and purchase one Commander 4000 Series Electric
Utility Line Truck from Terex Utilities, Inc., of Stockton, California, in an amount not to exceed
$300,000, utilizing the competitively -bid Sourcewell Contract No. 012418 -ALT.
