REGULAR CITY COUNCIL MEETING

The City Council Closed Session meeting of May 4, 2022, was called to order by Mayor Chandler
at 6:04 p.m.
Present: Council Member Khan, Council Member Kuehne, Council Member Nakanishi, and
Mayor Chandler
Absent: Mayor Pro Tempore Hothi
Also Present: City Manager Schwabauer, City Attorney Magdich, and Assistant City Clerk Farris
NOTE: City Attorney Magdich attended via teleconference.
At 6:04 p.m., Mayor Chandler adjourned the meeting to a Closed Session to discuss the above
matters. The Closed Session adjourned at 6:27 p.m.
At 7:04 p.m., Mayor Chandler reconvened the City Council meeting. City Attorney Magdich was
attending via teleconference and briefly lost connection. City Manager Schwabauer disclosed the
following action.

Mayor Chandler presented a proclamation to Police Chief Sierra Brucia proclaiming May 15 to 21,
2022 as National Police Week in the City of Lodi.
Council Member Nakanishi made a motion, second by Council Member Khan, to approve the
following items hereinafter set forth, except those otherwise noted, in accordance with the
report and recommendation of the City Manager.

The minutes of April 12, 2022 (Shirtsleeve Session) and April 19, 2022 (Shirtsleeve Session)
were approved as written.
Adopted Resolution No. 2022-106 authorizing the City Manager to purchase two chemical
storage tanks from Poly Processing, of French Camp, for storage of sodium hypochlorite at
Surface Water Treatment Facility, in the amount of $29,358.
Adopted Resolution No. 2022-107 awarding the contract for the 2021/2022 Pavement
Resurfacing Project, Various Locations, to American Pavement Systems, Inc., of Modesto, in the
amount of $1,198,240; authorizing the City Manager to execute change orders in an amount not
to exceed $100,000; and appropriating funds in the amount of $178,240.

Adopted Resolution No. 2022-110 approving the Final Map and authorizing the City Manager to
execute an Improvement Agreement for Gateway South Subdivision, Unit No. 4, Tract No. 4107.
Adopted Resolution No. 2022-111 ratifying the San Joaquin Council of Governments' Annual
Financial Plan for Fiscal Year 2022/23.
Adopted Resolution No. 2022-112 accepting 2018 Parks Bond Act Per Capita Grant funds from
State of California for the Raising Enze Pool Floor Project in the amount of $219,679.
Adopted the following resolutions pertaining to the November 8, 2022, General Municipal
Election: Resolution No. 2022-113 calling and giving notice of the General Municipal Election;
Resolution No. 2022-114 requesting the San Joaquin County Board of Supervisors to render
specified services for the conduct of a General Municipal Election; Resolution No. 2022-115
setting forth the Council's policy regarding impartial analysis, arguments, and rebuttal arguments
for any measure(s) that may qualify to be placed on the ballot; and Resolution No. 2022-116
adopting regulations for candidates for elective office pertaining to candidates' statements
submitted to the voters at the General Municipal Election.

Authorized the City Clerk to grant request for leave to present late claim by Lauren Borges,
pursuant to Government Code Section 911.6(a).
This item was pulled at the request of staff.
Set a public hearing for May 18, 2022 introducing an ordinance amending Lodi Municipal Code
Title 13 - Public Services - by repealing and reenacting Chapter 13.16, "Solid Waste," in its
entirety.
Victor Maestas and Michele Pitta, members of the public, spoke about the traffic issues on
Westgate Drive and requested traffic calming measures. They presented a petition
(filed) requesting speed radar signs on the north and south ends of Westgate Drive.
Chelsea Taylor, a member of the public, spoke about the need for repairs, maintenance, working
restrooms, and lights at the skate park.
Adam Dunlap, a member of the public, spoke about the need for repairs, a water fountain, and
restrooms at the skate park.
Pat B. (no last name given), a member of the public, spoke about damage at the skate park from
bikes and scooters and inquired about the use of grants to pay for a concrete skate park.
City Manager Schwabauer stated that significant repairs are scheduled at the skate park in June
and steel will be used to reinforce the ramps, but a larger project is not scheduled due to funding.
He further noted that the original skate park was built with the help of public fundraising and
suggested the group become involved by fundraising and seeking grants.
Park Project Coordinator Steve Virrey stated the restrooms are only open when renters are
present; they are closed on a daily basis due to vandalism.
Council Member Nakanishi requested that the City Manager speak with the Parks, Recreation
and Cultural Services (PRCS) Department regarding finding a solution for the bathroom issue.
Council Member Kuehne asked for PRCS to investigate two lights at the tennis court pointing
towards the Skate Park. He further encouraged the group to partner with foundations to get
funding for the park.
Council Member Khan encouraged the group to seek grants and asked staff to find a way to keep
the bathrooms open.
C-12 Set Public Hearing for May 18, 2022 to Consider Ordinance Amending Lodi Municipal
Code Title 17 –Development Code –Section 17.34.060.A.3, “GC and Industrial Districts,”
to Revise Standards for Signs for These Zoning Districts, and Adding Section 17.34.070.H,
“Electronic Message Signs on City Property,” to Create a New Type of Advertising Sign

In response to Council Member Nakanishi's question regarding the traffic issues on
Westgate Drive, Public Works Director Charlie Swimley stated that barricades cannot be added to
public roads but that he would have staff check on the installation of stop signs.
Council Member Kuehne stated that he has received complaints about this area and suggested
barriers until the houses are built.
Council Member Khan extended greetings to the Muslim community for Eid al-Fitr and to the
Hispanic community for Cinco de Mayo.
In response to Council Member Khan, City Manager Schwabauer stated he would check with
Business Development Manager Astrida Trupovnieks regarding the second street light survey.
Council Member Nakanishi reported on the Eastern San Joaquin Groundwater Authority
activities.
Council Member Kuehne spoke regarding the success of Love Lodi, the Port of Stockton
decreasing truck traffic on the Altamont, the upcoming One Voice trip, the Street Fair, and the
return of the Farmers Market.
Mayor Chandler spoke regarding Love Lodi, the Street Fair, the presentation at Hutchins Street
Square by Terry Clark regarding the Sunset Theater, safety concerns at Lodi Lake, and the Art in
Public Places monument being planned near Interstate 5.
None.
Notice thereof having been published according to law, an affidavit of which publication is on file
in the office of the City Clerk, Mayor Chandler called for the public hearing to consider adopting a
resolution approving the Draft 2022-2023 Community Development Block Grant (CDBG) Annual
Action Plan.
Neighborhood Services Manager Jennifer Rhyne provided a PowerPoint presentation regarding
the Community Development Block Grant (CDBG) Annual Action Plan (AAP). Specific topics of
discussion included CDBG purpose, objectives, goals, 2019-2023 Consolidated Plan, draft 2022-
2023 AAP, AAP process, CDBG budget, requests for funding, funding recommendations, and
recommended action.
Council Member Kuehne asked for clarification on which projects provided the $108,000 in prior
year funds (page 9 of the PowerPoint) and Ms. Rhyne stated she will research and provide that
information.
In response to Mayor Chandler, City Manager Schwabauer confirmed that the Enze Pool project
was funded by a grant approved as C-9 on the agenda.

In response to Council Member Khan, Ms. Rhyne stated that the Alley Improvement Project
Phase 9 has already started. City Manager Schwabauer further stated that sidewalks are eligible
if there is an ADA issue or if they are located in target areas and that Public Works staff provides
recommendations for where the improvements should take place.
Council Member Kuehne commented that Council is asked to approve the plan without having the
final dollar amounts. City Manager Schwabauer clarified that staff has fairly close estimates and
that to delay would risk not meeting federal deadlines.
Mayor Chandler opened the public hearing for public comment.
There being no public comments, Mayor Chandler closed the public hearing.
Council Member Kuehne made a motion, second by Council Member Khan, to adopt Resolution
No. 2022-117 approving the Draft 2022-2023 Community Development Block Grant (CDBG)
Annual Action Plan.

and Private Property,' by Repealing and Reenacting Section 9.18.045, 'Permit Caps,' to Replace
Static Caps on Motorized Food Preparation Units and Produce/Seafood Trucks with Variable
Caps Based on Population in Lodi."

In response to Council Member Nakanishi, City Manager Schwabauer confirmed the limit is
$60,000.
Council Member Kuehne made a motion, second by Council Member Nakanishi, to adopt
Ordinance No. 2000 entitled, "An Ordinance of the Lodi City Council Amending Lodi Municipal
Code Chapter 2.14, 'City Attorney,' by Repealing and Reenacting Section 2.14.10, 'City Attorney,'
and Adopt Resolution Rescinding Resolution No. 2011-134 and Authorizing Specified Positions
Monetary Settlement Authority Relating to General Liability Claims."

City Manager Schwabauer provided a short presentation explaining the need to appoint a new
secretary to the agencies following the appointment of a new City Clerk.
Council Member Nakanishi made a motion, second by Council Member Kuehne, to adopt
Resolution Nos. LPIC2022-03, IDA-46, LFC2022-33, and LPFA2022-04 to appoint the City Clerk
as the Secretary for the Lodi Improvement Corporation, Industrial Development Authority, Lodi
Financing Corporation, and Lodi Public Financing Authority.

There being no further business to come before the City Council, the meeting was adjourned
at 8:11 p.m., in memory of Darrell Drummond, a former Lodi businessman and activist, who
passed away on April 15.
