BACKGROUND INFORMATION: The Lodi Municipal Code, which includes regulations for "food trucks," currently imposes strict limits on the number of permits which can be issued for "motorized food preparation units" and "produce/seafood trucks" (referred to generally as "food trucks" in this report). Without a permit, a food truck cannot operate legally in Lodi. The permit caps have not been changed since the City first adopted the current regulations in 2009, limiting "motorized food preparation units" to 22 and "produce/seafood trucks" to 3. All of the available permits have been issued. The City has been approached by additional food truck operators who would like to obtain a permit to operate in Lodi in response to increased demand for this service. Staff has prepared proposed changes to the existing permit cap which would tie the number of permits to the population of Lodi, allowing the number of permits to increase over time to match the city's population. The changes proposed by staff would immediately increase the number of "motorized food preparation permits" to 25. The number of "produce/seafood truck" permits would not increase. Future increases would be possible as the City's population continues to grow. FISCAL IMPACT: Not applicable. FUNDING AVAILABLE: Not applicable. John R.
