AGENDA TITLE: Adopt Resolution Authorizing City Manager to Waive Bid Process and Purchase
Submersible Pump Assembly from Shape, Inc., of Pleasanton, for Shady Acres Storm Lift
Station ($33,771)

RECOMMENDED ACTION: Adopt resolution authorizing City Manager to waive bid process and
purchase submersible pump assembly from Shape, Inc., of Pleasanton,
for Shady Acres Storm Pump Station, in the amount of $33,771.
BACKGROUND INFORMATION: The City operates and maintains a total of fourteen storm pump lift stations.
Storm pump lift stations are located throughout the City and are used to
convey stormwater from nearby watersheds and storm basins to approved
discharge locations.
The Shady Acres Storm Pump Station, located at 356 Shady Acres Dr. is predominantly used to convey storm
water to the Woodbridge Irrigation District canal. The Public Works Department is responsible for maintaining
continuous operation of all storm lift stations serving our customers and minimizing the possibility of surface
flooding.
Shady Acres Storm Station contains a total of five pumps. There are three duty pumps designed for use during
storm events, and two "clean-up" pumps that are designed to only remove nuisance water such as irrigation run-
off. The "clean-up" pumps are used year round and are not factored into the pump station capacity. In
December 2021 (subsequent to the historic October 2021 storm) one of the 12 -horsepower "clean-up" pumps
became inoperable (Exhibit 1). This pump has been in service an estimated 30 years. Staff recommends
purchasing a new 12HP Flygt submersible pump based on the age of the existing pump.
Per Lodi Municipal Code Section 3.20.070, bidding shall be dispensed with when the commodity can be
obtained from only one vendor due to the need for branded replacement parts or supplies for equipment of like
brand. Shape, Inc, is the sole proprietor in Northern California for Flygt submersible pumps (Exhibit 2).
Staff recommends authorizing City Manager to waive bid process and purchase submersible pump assembly
from Shape, Inc., of Pleasanton, for Shady Acres Storm Pump Station, in the amount of $33,771.
Fiscal Impact: The pump replacement is necessary to reduce operations and
maintenance costs and provide reliable service. This project does not
impact the General Fund.

RESOLUTION NO. 2022-71
A RESOLUTION OF THE LODI CITY COUNCIL AUTHORIZING THE
CITY MANAGER TO WAIVE THE BID PROCESS AND PURCHASE A
SUBMERSIBLE PUMP ASSEMBLY FROM SOLE -SOURCE VENDOR SHAPE, INC.,
OF PLEASANTON, FOR THE SHADY ACRES STORM LIFT STATION
WHEREAS, storm pump lift stations are located throughout the City and are utilized to
convey stormwater from nearby watersheds and storm basins into approved discharge
locations; and
WHEREAS, the Shady Acres Storm Pump Station, located on Shady Acres Drive, is
predominantly used to convey stormwater to the Woodbridge Irrigation District canal; and
WHEREAS, the cleanup pump has been in service for 30 years and became inoperable
in December 2021; and
WHEREAS, per Lodi Municipal Code §3.20.070, the bidding process may be dispensed
when the commodity can be obtained from only one vendor, due to need for branded
replacement parts or supplies for equipment of like brand; and
WHEREAS, staff recommends the City Council authorize the City Manager to waive the
bid process and purchase a submersible pump assembly from Shape, Inc., of Pleasanton, in the
amount of $33,771.
NOW, THEREFORE, BE IT RESOLVED that the Lodi City Council does hereby
authorize the City Manager to waive the bid process and purchase a submersible pump
assembly from sole -source vendor Shape, Inc., of Pleasanton, California, in the amount of
$33,771; and
BE IT FURTHER RESOLVED, pursuant to Section 6.3q of the City Council Protocol
Manual (Res. No. 2019-223), the City Attorney is hereby authorized to make minor revisions to
the above -referenced document(s) that do not alter the compensation or term, and to make
clerical corrections as necessary.
