HomeMy WebLinkAboutAgenda Report - March 16, 2022 C-09CITY OF ATO 06le io azt� C A L I F O R N I A AGENDA ITEMC'09 COUNCIL COMMUNICATION AGENDA TITLE: Adopt Resolution Accepting the Lodi Fire Department's Annual Compliance Report as Mandated by Senate Bill No. 1205 MEETING DATE: March 16, 2022 PREPARED BY: Fire Chief RECOMMENDED ACTION: Adopt resolution accepting the Lodi Fire Department's annual compliance report as mandated by Senate Bill No. 1205 BACKGROUND INFORMATION: Senate Bill No. 1205 mandates that every city fire department shall report annually to its administering authority on its compliance with the Health and Safety Code, Sections 13146.2 and 13146.3. The bill states that the report shall occur when the administering authority discusses its annual budget, or at another time determined by the administering authority. The California State Fire Marshal mandates that certain occupancy types be inspected annually. These mandated occupancy types include private and public schools, hotels, motels, lodging houses and apartment/condominium buildings. The purpose of annual fire inspections is to mitigate known hazards, reduce risk to the community, and ensure reasonable compliance with the California Fire Code. The Lodi Fire Department performs the mandated inspections, in addition to other inspections at local businesses, as part of the Department's prevention program. In 2021, the Lodi Fire Department inspected 100% of the state mandated annual inspections within the calendar year. California Health and Safety Code Section 13146.2 mandates that the local fire department inspect all hotels, motels and lodging houses once annually. The Lodi Fire Department inspected twenty-one (21) out of twenty-one (21) hotels, motels and lodging houses during the 2021 calendar year. California Health and Safety Code Section 13146.2 mandates that the local fire department inspect all apartments once annually. The California Building Code also specifies that condominiums should be considered apartments for building code application. An apartment shall consist of three or more attached units, and excludes all duplex and townhome buildings as defined by code. The Lodi Fire Department inspected four hundred eighty (480) out of four hundred eighty (480) apartment/condominium complexes during the 2021 calendar year. The Lodi Fire Department inspected forty-nine (49) out of forty-nine (49) school facilities during the 2021 calendar year. In total, the Lodi Fire Department conducted 527 state -mandated inspections during the 2021 calendar year. Further, the acceptance of this compliance report and the recommended Resolution fulfill the statutory requirements contained in California Health and Safety Code Section 13146.2, 13146.3 and 13146.4, as amended by SB 1205. NOW, THEREFORE, BE IT RESOLVED that the Lodi City Council does hereby accept the Lodi Fire Department's Annual Compliance Report as mandated by Senate Bill No. 1205. BE IT FURTHER RESOLVED, pursuant to Section 6.3q of the City Council Protocol Manual (Res. No. 2019-223), the City Attorney is hereby authorized to make minor revisions to the above -referenced document(s) that do not alter the compensation or term, and to make clerical corrections as necessary.
