HomeMy WebLinkAboutResolutions - No. 2022-34RESOLUTION NO. 2022-34 A RESOLUTION OF THE LODI CITY COUNCIL AUTHORIZING THE CITY MANAGER TO EXECUTE ASSIGNMENT ADMINISTRATION AGREEMENT FOR WESTERN AREA POWER ADMINISTRATION BASE RESOURCE PERCENTAGE BETWEEN THE NORTHERN CALIFORNIA POWER AGENCY AND CITY OF LODI WHEREAS, on December 2, 2020, the City Council approved Resolution No. 2020-288 executing Base Resource (BR) Contract 20 -SNR -02347 with the Western Area Power Administration (WAPA); and beginning January 1, 2025, Lodi will receive 0.55792 percent of the hydropower resource marketed and sold by WAPA; and WHEREAS, the existing Assignment Administration Agreement (AAA) with NCPA, whereby NCPA accepts assignment of LEU's Base Resource Percentage, will expire on December 31, 2024; and WHEREAS, the new AAA sets forth the terms and conditions under which NCPA will supply Joint Assignment Administration Services on behalf of NCPA members who assign their BR percentage to NCPA effective January 1, 2025; and WHEREAS, the AAA shall remain in effect until the earlier of: (a) December 31, 2054; or (b) until it is terminated and will be used in conjunction with the 2025 BR Contract to preserve the key principles and practices that are reflected in the AAA that is currently in effect today; and WHEREAS, by executing the new AAA, Lodi can assign its BR percentage to NCPA and NCPA will manage the daily operation and transactions of the assigned BR percentage on behalf of the participants; and WHEREAS, the Request for Assignment of Lodi's BR Percentage to NCPA, authorized by separate City Council action, provides for NCPA to assume all the rights, duties, and obligations associated with receiving Lodi's BR Percentage under BR Contract 20 -SNR -02347; and WHEREAS, on December 9, 2021, the Risk Oversight Committee received a report and recommended approval of the AAA with NCPA. NOW, THEREFORE, BE IT RESOLVED that the Lodi City Council does hereby authorize the City Manager to execute the Assignment Administration Agreement (AAA) for Western Area Power Administration Base Resource Percentage between the Northern California Power Agency and the City of Lodi.
