HomeMy WebLinkAboutResolutions - No. 2022-24RESOLUTION NO. 2022-24 A RESOLUTION OF THE LODI CITY COUNCIL DECLARING AN EMERGENCY CONDITION REQUIRING THE IMMEDIATE REPAIR OF MOKELUMNE RIVERBANK AT LODI LAKE PARK WHEREAS, a portion of the riverbank on the Mokelumne River that runs along the northern boundary of Lodi Lake Park has been severely eroded in past years and is threatening park facilities; and WHEREAS, the City initiated a State -funded project to repair this portion of river in 2019; however, unprecedented delays in the State permitting process has delayed this project for two years; and WHEREAS, City Council awarded the Lodi Lake Riverbank Stabilization Project to ASTA Construction Company, of Rio Vista, on December 1, 2021; and WHEREAS, work can proceed outside of the riverbank area at this time; however, the City is still waiting for the State Land Commission (SLC) approval to allow work to be performed within the riverbank area. This final layer of approval is expected on February 25, 2022; and WHEREAS, from final SLC approval (February 25, 2022) to the time Woodbridge Irrigation District (WID) raises the river water level (March 6, 2022), the contractor will only have 10 days to restore the portion of riverbank that lies below the normal river water levels, which will require the contractor to work weekends to complete the work on schedule; and WHEREAS, the Declaration of Emergency is needed since the rock is sourced from the Amador Quarry, which is licensed to operate during weekdays unless there is a declared emergency; and WHEREAS, if the riverbank restoration cannot be completed prior to WID raising the Woodbridge Dam, this project will be postponed another year, allowing further riverbank erosion; and WHEREAS, staff recommends declaring an emergency condition requiring the immediate repair of Mokelumne Riverbank at Lodi Lake Park, which will allow the quarry to operate on weekends to supply rock needed for the riverbank restoration. NOW, THEREFORE, BE IT RESOLVED that the Lodi City Council does hereby declare an emergency condition requiring the immediate repair of Mokelumne Riverbank at Lodi Lake Park, which will allow the quarry to operate on weekends to supply rock needed for the riverbank restoration.
