REGULAR CITY COUNCIL MEETING
CARNEGIE FORUM, 305 WEST PINE STREET
WEDNESDAY, MARCH 16, 2022
The City Council Closed Session meeting of March 16, 2022, was called to order by
Mayor Chandler at 5:48 p.m.
Present: Council Member Khan, Council Member Kuehne, Mayor Pro Tempore Hothi, and
Mayor Chandler
Absent: Council Member Nakanishi
Also Present: City Manager Schwabauer, City Attorney Magdich, and Assistant City Clerk Farris
NOTE: Council Member Khan arrived at 5:52 p.m.
At 5:48 p.m., Mayor Chandler adjourned the meeting to a Closed Session to discuss the above
matters. The Closed Session adjourned at 7:05 p.m.
At 7:05 p.m., Mayor Chandler reconvened the City Council meeting, and City Attorney Magdich
disclosed the following actions.
Item C-2a) was discussion and direction with no reportable action.
Item C-2b) was discussion with no reportable action.

Council Member Khan made a motion, second by Mayor Pro Tempore Hothi, to approve the
following items hereinafter set forth, in accordance with the report and recommendation of the
City Manager.

Claims were approved in the amount of $6,150,219.60.
The minutes of February 16, 2022 (Regular Meeting), February 16, 2022 (Special Meeting),
February 22, 2022 (Shirtsleeve Session), and March 1, 2022 (Shirtsleeve Session) were
approved as written.
Approved plans and specifications and authorized advertisement for bids for State Route 99 /
Turner Road Interchange Improvements.
Adopted Resolution No. 2022-64 awarding a contract for the Fire Station 3 and Fire Station 4
Security Gates and Generator Project to Sauren Construction, Inc., of Newcastle, in the amount
of $374,972, authorizing the City Manager to execute change orders in an amount not to exceed
$37,000, and appropriating funds in the amount of $157,000.
Received the First and Second Quarters Fiscal Year 2021/22 Water, Wastewater and Electric
Utility Department financial reports.

Adopted Resolution No. 2022-65 authorizing the City Manager to execute Amendment No. 1 to
the Professional Services Agreement with Poser Construction, of Lodi, for general construction, in
the amount of $15,000.

Received the annual report regarding boards, committees, and commissions relating to
attendance.
Adopted Resolution No. 2022-66 accepting the Lodi Fire Department's annual compliance report
as mandated by Senate Bill No. 1205.
Alex Aliferis, a member of the public, thanked the Council for the tree trimming project on the
Eastside and spoke about DNA testing involved with COVID testing and COVID vaccines not
being safe.
Council Member Nakanishi read an excerpt from Lodian Bill Webb's obituary as it spoke of the
love he had for the Lodi community.
Council Member Kuehne spoke about the artwork on the parking garage commemorating the

E. Comments by the City Council Members on Non-Agenda Items

anniversary of the 19th Constitutional Amendment and celebrating women's right to vote; the
Rotary shrimp feed which raised money for the Loel Center expansion; and the Chamber of
Commerce membership drive.
Council Member Khan expressed appreciation for the trash cleanup and graffiti abatement on the
Eastside and stated he is concerned about the number of smoke shops licensed to do business
in residential areas.
Council Member Chandler spoke about Rotary's Shrimpmania and the Chamber of Commerce
membership drive, and thanked Community Development Director John Della Monica for his
department's efforts in cleaning up Sacramento Street.
City Manager Schwabauer asked Deputy City Manager Andrew Keys to report on the recent bond
purchase. Mr. Keys stated that despite the volatile bond market, the City was able to purchase
bonds at 3.44%, there will be $1.06 million in savings, and $15 million will be available for the
new animal shelter.
Notice thereof having been published according to law, an affidavit of which publication is on file
in the office of the City Clerk, Mayor Chandler called for the public hearing to consider a
resolution adopting pre-approved Proposition 218 Consumer Price Index-based annual
adjustment to rates for solid waste collection.
Public Works Department Management Analyst Rebecca Areida-Yadav provided a presentation
regarding solid waste rates. Specific topics of discussion included contract, CPI rate adjustment
factor, county gate fees, example rate changes, and recommended action.
Council Member Nakanishi stated that this increase is a contractual obligation.
Mayor Chandler opened the public hearing for public comment.
Alex Aliferis, a member of the public, stated that he understands that this is part of the contract
but the City is in a time of unprecedented inflation right now.
There being no further public comments, Mayor Chandler closed the public hearing.
Mayor Pro Tempore Hothi made a motion, second by Council Member Nakanishi, to adopt
Resolution No. 2022-67 adopting pre-approved Proposition 218 Consumer Price Index-based
annual adjustment to rates for solid waste collection.

F. Comments by the City Manager on Non-Agenda Items
G. Public Hearings
G-1 Public Hearing to Consider Resolution Adopting Pre-Approved Proposition 218 Consumer
Price Index-Based Annual Adjustment to Rates for Solid Waste Collection (PW)

Parks, Recreation and Cultural Services Deputy Director Laura Johnston provided a presentation
regarding Parks, Recreation and Cultural Services master fees and charges. Specific topics of
discussion included pyramid methodology and comprehensive list of fees and charges.
In response to Mayor Pro Tempore Hothi, Ms. Johnston stated that there have not been previous
across-the-board increases, but there were select increases in 2015.
Council Member Nakanishi expressed his support of the increases, citing the need for park
maintenance.
Council Member Kuehne made a motion, second by Mayor Pro Tempore Hothi, to adopt
Resolution No. 2022-68 approving current and future Parks, Recreation and Cultural Services
master fees and charges.

Neighborhood Services Manager Jennifer Rhyne provided a brief overview of the Housing
Element Annual Progress Report and introduced Austin Knudsen, of Michael Baker International.
Mr. Knudsen provided a PowerPoint presentation regarding the 2021 Housing Element Annual
Progress Report. Specific topics of discussion included State reporting requirements, current
Housing Element, Regional Housing Need Allocation, Housing Development applications
submitted, housing units permitted, regional housing needs allocation process, new housing
development conclusions and observations, Housing Element program implementation, and
recommendation.
In response to Council Member Nakanishi, City Manager Schwabauer stated that at this time
there are no sanctions for failure to meet the standards, however, cities continue to advocate on
this issue as businesses build houses, not cities, so the most a city can do in this regard is to
make building affordable housing easy for those businesses.
Council Member Kuehne stated that Lodi is outperforming other cities within the County in regard
to the Regional Housing Need Allocation, proposed a possible donation of City land for high-
density/affordable housing, and opined that the State needs to step up their game in regard to
grants.
Mayor Chandler stated that it is important to sustain agricultural lands around Lodi.
Council Member Kuehne made a motion, second by Mayor Pro Tempore Hothi, to adopt
Resolution No. 2022-69 approving 2021 Housing Element annual progress report and direct staff

regarding the introduction of an ordinance amending Chapter 3.20, "Purchasing System."
Specific topics of discussion included reasons behind change and ordinance revisions.
In response to Council Member Nakanishi, City Manager Schwabauer stated that Public Works
projects are the construction and maintenance of public assets and the proposed ordinance
would make the contracts more efficient.
Council Member Nakanishi made a motion, second by Council Member Kuehne, to introduce
Ordinance No. 1995 amending Lodi Municipal Code Chapter 3.20, "Purchasing System," by
repealing and reenacting Section 3.20.105, "Public Works Projects - Informal Bid Procedures."
