RECOMMENDED ACTION: Conduct a public hearing to consider adoption of a resolution to
vacate a 10 -Foot Public Utility Easement Located at 800 thru 830
Talavera Circle; APNs: 027-310-29, 28, 27, 26, 25, and 24.
BACKGROUND INFORMATION: At its regular meeting on December 1, 2021 the Council adopted a
resolution of intention to vacate an existing 10 -foot public utility
easement located at 800 thru 830 Talavera Circle; APNs: 027-310-
29, 28, 27, 26, 25, and 24, and refer the matter to the Planning Commission. Posting, publishing and
mailing notices have been accomplished.
The proposed easement vacation is requested by the current owner, Michael Florsheim, DM2
Investments, LLC. In 1993, a 10 -foot public utility easement was dedicated over the property formerly
known as 2040 Cochran Road, as shown on Exhibit A. The easement was originally dedicated for the
purpose of overhead electrical utility services. The easement is no longer needed as the current
development was conditioned to dedicate new public utility easements for the undergrounding of the
electric utility lines. The recommended public utility easement abandonment will allow full use of the
parcel by the new parcel owners.
The vacation request was approved by the Planning Commission at the regularly scheduled Planning
Commission meeting on January 26, 2022. The Planning department concurs with the proposed Council
action.
The City of Lodi Electric Utility Department, City of Lodi Water/Wastewater and Street Divisions, AT&T,
Pacific Gas & Electric, and Comcast have approved the 10 -foot public utility easement vacation without
further comment or conditions.
Staff recommends that vacating the existing 10 -foot public utility easement located at 800 thru 830
Talavera Circle; APNs: 027-310-29, 28, 27, 26, 25, and 24.
FISCAL IMPACT: Not applicable.
FUNDING AVAILABLE: Not applicable.

LEGAL DESCRIPTION
A non-exclusive Public Utility Easement ten (10) feet in uniform width, being more
particularly described as the east ten (10) feet of the real property described as follows.
A portion of the Northeast Quarter of Section 10, Township 3 North, Range 6 East,
Mount Diablo Base and Meridian, described as follows:
Commencing at a point on the South line of said Northeast 1/4, 100 feet West of the
Southeast corner of said Northeast'/4 and being the Southeast corner of the land
described in Deed to John F. Capell, et al, recorded January 6, 1971, in Vol. 3477 of
Official Records, Page 237, San Joaquin County Records; thence North along the East
line of said Capell land, 300.00 feet to the point of beginning of the herein described
land; thence continue North along the East line of said Capell land, 525.00 feet to the
Northeast corner thereof; thence North 89112'30" West, along the North line of said
Capell land, 475.00 feet; thence South 525.00 feet; thence South 89012'30" East,
475.00 feet to the point of beginning.
EXCEPTING THEREFROM that portion conveyed to the City of Lodi by Deed recorded
November 30, 1972 in Vol. 3714 Page 142 Instrument No. 57041, San Joaquin County
Records.

A RESOLUTION OF THE LODI CITY COUNCIL VACATING A
10 -FOOT PUBLIC UTILITY EASEMENT LOCATED AT
800 THROUGH 830 TALAVERA CIRCLE;
APNS: 027-310-29, 28, 27, 26, 25, AND 24
WHEREAS, in 1993, a 10 -foot public utility easement was dedicated over the property

10 -foot Public Utility Easement located at 800 through 830 Talavera Circle; APNs: 027-310-29,
28, 27, 26, 25, and 24; and
BE IT FURTHER RESOLVED, pursuant
Manual (Res. No. 2019-223), the City Attorney is
the above -referenced document(s) that do not
clerical corrections as necessary.
