2021-2023 Sidewalk and Miscellaneous Concrete Repair Program
($153,590), and Appropriating Funds ($45,207)

RECOMMENDED ACTION: Adopt resolution authorizing City Manager to execute change
orders to 2021-2023 Sidewalk and Miscellaneous Concrete
Repair Program, in an amount not to exceed $153,590, and
appropriating funds in the amount of $45,207.
BACKGROUND INFORMATION: On April 21, 2021, Council approved specifications and adopted
a resolution authorizing the City Manager to award a contract to
the lowest responsive bidder, not to exceed $250,000; and
execute change orders, not to exceed $50,000. On July 7, 2021, the City Manager executed the
contract with Popuch Concrete Contracting, Inc., of Lodi, in the amount of $190,480. The contract is
intended to facilitate citywide concrete repairs on an as -needed basis.
Occasionally, other divisions within the City need to have miscellaneous concrete work done. It is
beneficial for the City to utilize the existing contract. If approved, this change order adds additional
funding in the amount of $8,383 to replace a sinking sidewalk near the clarifier at White Slough
Water Pollution Control Facility; and adds additional State Transit Development Act (TDA) funds in
the amount of $45,207 for this fiscal year for a total change order amount of $53,590. Due to
additional funds ($100,000) recently becoming available through the Federal American Rescue Plan
Act of 2021 for east side sidewalk repairs, we are requesting the City Manager change order
authority increase to $153,590 to be able to utilize those funds at a later date. The requested
appropriation is necessary to authorize the expenditure of the additional TDA funding that was not
anticipated during the budget process.
Staff recommends authorizing City Manager to execute change orders to 2021-2023 Sidewalk and
Miscellaneous Concrete Repair Program, in an amount not to exceed $153,590, and appropriating
funds in the amount of $45,207.
FISCAL IMPACT: This project extends the useful life of City sidewalks and miscellaneous
concrete. This project does not impact the general fund.

Brief Description Of Work
Occasionally other divisions need to have small amounts of miscellaneous concrete work done. It is beneficial for the City to
utilize this existing contract for the concrete needed by these divisions. This change order is adding money for work for to replace
a sinking sidewalk near the clarifier at White Slough Water Pollution Control Facility. See attached invoice. This invoice is also
adding additional funds to the contract recieved from TDA fund for this fiscal year

RESOLUTION NO. 2022-27
A RESOLUTION OF THE LODI CITY COUNCIL AUTHORIZING THE
CITY MANAGER TO EXECUTE CHANGE ORDERS TO 2021-2023 SIDEWALK
AND MISCELLANEOUS CONCRETE REPAIR PROGRAM; AND FURTHER
APPROPRIATING FUNDS
WHEREAS, on April 21, 2021, Council approved specifications and adopted a resolution
authorizing the City Manager to award a contract for the 2021-2023 Sidewalk and
Miscellaneous Concrete Repair Program to the lowest responsive bidder, in an amount not to
exceed $250,000, and execute change orders, in an amount not to exceed $50,000; and
WHEREAS, on July 7, 2021, the City Manager executed the contract with Popuch
Concrete Contracting, Inc., of Lodi, in the amount of $190,480, to facilitate Citywide concrete
repairs on an as -needed basis; and
WHEREAS, occasionally, other divisions within the City need to have miscellaneous
concrete work done and it is beneficial for the City to utilize the existing contract; and
WHEREAS, staff needs to replace a sinking sidewalk near the clarifier at White Slough
Water Pollution Control Facility; and
WHEREAS, staff recommends authorizing the City Manager to execute change orders
to the 2021-2023 Sidewalk and Miscellaneous Concrete Repair Program, in an amount not to
exceed $153,590; and
WHEREAS, staff further recommends appropriating funds in the amount of $45,207 from
the State Transit Development Act (TDA) Bike Ped Fund (33199000.77020).
NOW, THEREFORE, BE IT RESOLVED that the Lodi City Council does hereby
authorize the City Manager to execute change orders to the 2021-2023 Sidewalk and
Miscellaneous Concrete Repair Program, in an amount not to exceed $153,590; and
BE IT FURTHER RESOLVED that the Lodi City Council does hereby authorize
appropriating funds in the amount of $45,207 from the State Transit Development Act (TDA)
Bike Ped Fund (33199000.77020); and
BE IT FURTHER RESOLVED, pursuant to Section 6.3q of the City Council Protocol
Manual (adopted 11/6/19, Resolution No. 2019-223), the City Attorney is hereby authorized to
make minor revisions to the above -referenced document(s) that do not alter the compensation
or term, and to make clerical corrections as necessary.
