AGENDA PTEM 6'�2% CITY OF LODI COUNCIL COMMUNICATION TM AGENDA TITLE: Set Public Hearing for January 5, 2022 to Introduce Ordinance Amending Lodi Municipal Code Title 13 "Public Services," by Repealing and Re-enacting Section 13.12.150 "Connections Outside City" in its Entirety MEETING DATE: December 1, 2021 PREPARED BY: Public Works Director RECOMMENDED ACTION: Set Public Hearing for January 5, 2022 to introduce ordinance amending Lodi Municipal Code Title 13 "Public Services," by Repealing and Re- enacting Section 13.12.150 "Connections Outside City" in its Entirety. BACKGROUND INFORMATION: The City of Lodi General Plan includes goals that encourage compact development within the General Plan boundaries and to discourage leapfrog development and urban sprawl. To support these goals, the Lodi Municipal Code currently restricts the City from accepting discharge from private facilities or properties outside the City of Lodi service area into the domestic sewerage or storm drainage systems as reflected in Section 13.12.150.B.1. Cherokee Memorial Park Cemetery (Cherokee Memorial) is a non-profit company that is licensed with the State of California Cemetery and Funeral Bureau. Cherokee Memorial serves Lodi, Stockton, and portions of the San Joaquin Valley; and is located just outside the City's eastern city limits at the corner of Harney Lane and Beckman Road (Exhibit A). The facility is currently served by a septic system that is regulated by the San Joaquin County Health Department. Cherokee Memorial has recently embarked on the design of an 18,000 square foot addition to the north side of the Chapel building. The proposed addition includes administrative offices and funeral home functions and will require significantly expanding the existing chapel septic system. For this reason, Cherokee Memorial management is requesting the City consider providing sewer service outside the City to accommodate the addition to the Chapel building. Cherokee Memorial proposes to connect to the City's wastewater trunk line that is located approximately 120 feet north of the cemetery. The design concept includes a small force main located within County Right of Way along Beckman Road. The projected wastewater flows from the addition to the Chapel building are anticipated to be less than 1,500 gallons per day. This value is de minimis respective to the capacity of the pipeline serving the proposed connection. Staff normally would not recommend amending the Lodi Municipal Code to encourage a connection outside City limits. However, Cherokee Memorial does provide a State regulated sanitary service to the City of Lodi and surrounding areas. By adding language that allows Council to consider providing sewer service outside City limits to "existing publicly licensed sanitary service providers to City residents"; Council has the tools to respect the goals identified in the current General Plan while providing an option for improving the service level for our residents that need cemetery services. B.1 by adding the bold and italicized language below: B. Now therefore be it further ordained as follows: 1. Service Outside Lodi. Except as set forth below, no discharge from private facilities or properties outside the city of Lodi shall be allowed into the domestic sewerage or storm drainage systems. The city council may by contract allow connection from: (1) winery facilities outside Lodi to the industrial sewerage system on the terms set forth in this section so long as the system has adequate existing capacity to service the waste (2) publicly owned wastewater systems or existing publicly licensed sanitary service providers to City residents ("public district") to the domestic wastewater treatment system on terms set forth in this section so long as the system has adequate existing capacity to service the waste. If the proposed amendment is approved, Staff will prepare a memorandum of understanding with Cherokee Memorial identifying the terms and conditions associated with connecting to the City's wastewater system. The proposed MOU will be brought before City Council for approval at a later date. Applicants receiving services outside City limits currently pay a one-time capacity charge and a monthly sewer surcharge of 150% of the City's standard published rate for wastewater service. Staff recommends City Council set a Public Hearing for January 5, 2022 to introduce the ordinance amending Lodi Municipal Code Title 13 "Public Services," by repealing and re-enacting Section 13.12.150 "Connections Outside City" in its entirety. FISCAL IMPACT: The Wastewater Enterprise Fund will realize a small increase in rate revenue associated with the connection. FUNDING AVAILABLE: Not applicable. cl;�� Charles E.
