HomeMy WebLinkAboutMinutes - January 11, 2022 SSLODI CITY COUNCIL SHIRTSLEEVE SESSION CARNEGIE FORUM, 305 WEST PINE STREET TUESDAY, JANUARY 11, 2022 An Informal Informational Meeting ("Shirtsleeve" Session) of the Lodi City Council was held Tuesday, January 11, 2022, commencing at 7:05 a.m. Mayor Chandler attended the meeting via Zoom and had to leave the meeting at 8:00 a.m. Present: Council Member Khan, Council Member Kuehne, Council Member Nakanishi, Mayor Pro Tempore Hothi, and Mayor Chandler Absent: None Also Present: City Manager Schwabauer, City Attorney Magdich, and City Clerk Cusmir Community Development Director John Della Monica and Planner Paul Junker provided a PowerPoint presentation regarding the Sphere of Influence (SOI) and Municipal Services Review (MSR) updates. Specific topics of discussion included current SOI update process, SOI study areas, General Plan development phases, key terms, status of SOI and MSR, community meetings, West Study Area, South Study Area, East Study Area, Glick property, Highway 12 property, SOI/MSR update process, and what happens after the SOI/MSR update. Council Member Kuehne noted that this is an opportunity to create a buffer between the cities of Stockton and Lodi. Council Member Nakanishi stated that establishing the sphere of influence is long overdue and it is obvious to him that the Council should move forward. Council Member Khan spoke about the importance of managing Lodi's growth and the benefit to property owners that will have access to the City's utilities such as electric service. Mayor Chandler spoke about the work done on establishing an agricultural reserve. Council Member Kuehne elaborated on the MSR and providing services for annexed areas. Mayor Pro Tempore Hothi opened public comment. Pat Patrick, President and CEO of the Lodi Chamber of Commerce, provided public comment regarding the notices for the community meetings and suggested that Industrial be moved to Phase 1. Mr. Patrick also recommended a stop light be installed at Guild Avenue and Victor Road. Council Member Kuehne stated that he supports moving Industrial to Phase 1 and explained that the State owns the property at Guild and Victor and because CalTrans does not have a plan to install a traffic signal, the City is planning to install the signal. Council Member Kuehne also spoke about reviewing the City's development ordinances. A.Call to Order / Roll Call B.Topics B-1 Receive Presentation and Provide Direction Regarding Sphere of Influence and Municipal Servces Review Updates (CD) 1 Sean Ray, a resident in the proposed SOI, provided public comment regarding the potential for property tax increases and sidewalk construction if his property is annexed into the City of Lodi. John (last name inaudible), a property owner in the proposed SOI, provided public comment stating that he is interested in his property, on Highway 12, being included in the SOI. Jay Finkelstein, a resident in the proposed SOI, provided public comment voicing his concern about well and septic maintenance and the cost of hooking up to City utilities. Ron (last name inaudible), a resident in the proposed SOI, provided public comment voicing his concern regarding requirements for hooking up to City utilities if and when the surrounding properties are developed. He also asked about solar benefits offered by the City. Community Development Director Della Monica spoke about noticing for community meetings and the delays that were experienced due to problems with mail delivery. Greg Finkelstein, a resident in the proposed SOI, spoke about the different animal species that may be impacted by an annexation. Mayor Pro Tempore Hothi closed the public comments. City Manager Schwabauer spoke about how the City may address the issues with solar customers and net metering. Council Member Nakanishi stated that he supports "grandfathering" solar customers into the City. Council Member Khan agreed. Planner Junker stated that staff may bring back discussion regarding the Highway 12 property at a later date as that would increase the SOI. None. No action was taken by the City Council. D.Adjournment ATTEST: Jennifer Cusmir City Clerk 2 Sphere of Influence and Municipal Services Review City Council Shirtsleeve Presentation January 11, 2022 SOI/MSR UPDATE Purpose of Council Update •Report on the process of updating the Sphere of Influence and Municipal Services Review •Identify and discuss key SOI Study Areas. •Receive City Council direction on proposed SOI boundaries City Council Presentation SOI/MSR UPDATE Current SOI Process •In April 2021 the City Council approved a scope of services and agreement for PlaceWorks to prepare an EIR in conjunction with the SOI update. •The PlaceWorks CEQA analysis will: •Analyze actions to be taken by the City and LAFCo in updating the SOI •Provide programmatic coverage for future development in the City and in the SOI •Council direction on the SOI boundary is needed for PlaceWorks to begin work on the EIR City Council Presentation SOI STUDY AREAS City Council Presentation West Study Area Highway 12 Property East Study Area South Study Area GP DEVELOPMENT PHASES City Council Presentation West Study Area South Study Area East Study Area Highway 12 Property SOI/MSR UPDATE Key Terms of Discussion •“Sphere of Influence” or “SOI” is an area that is considered appropriate to add to a city. •“Municipal Services Review” or “MSR” is a formal evaluation of how public services would be provided to new areas of a city. •“LAFCo” is the Local Agency Formation Commission, reviews annexation proposals, SOI updates and MSR updates. City Council Presentation SOI/MSR UPDATE Status of Lodi’s SOI and MSR •The SOI and the MSR must be updated regularly (typically every five years) to be considered current. •Cortese Knox Hetrzberg Act requires LAFCos update SOIs every five years. •San Joaquin LAFCo does not consider Lodi’s SOI and MSR to be current. •No annexations of land to the City can occur until the SOI and MSR are updated. •The City is preparing the SOI and MSR updates and will submit them to LAFCo for approval. City Council Presentation Community Meetings Staff conducted virtual community meetings with three Study Areas: •West Study Area -October 11 th and October 25th •South Study Area -October 26th and November 2nd •East Study Area -October 14th •General Input: •West Area –Concern over annexing over public service requirements, conversion of historic farming,some support. •South Area –Concern over farmland conversion,some residents support development,some residents interested in connecting to City services. •East Area –Property owner concerned over impacts to farming,overall more support than opposition. •Detailed community input to be provided when Council conducts formal review of SOI amendments.
